DEMOCRATIC INDIA FOUNDATION

This deed of public charitable trust executed in Greater noida on this


day of jJULY 2019 by:

Mr. Santosh Pathak

AND

Mr. Rohit Pandey

AND

Mr. Anil upadhyay, S/o- Late K.p upadhyay, R/o- Flat No-A-36,
Senior citizen society,Pocket-4,Greater Noida-Distt-Gautam
Budhh nagar210308(u.p).

1. Amit Kumar s/o Virendra singh ,R/O 92,Panchayatan


inayatpur,Greater Noida,Distt-Gautam Buddh nagar-
21306Hereinafter referred as Second Trustee and Secretary of
the Trust).

Which expression unless repugnant to the context or meaning thereof


includes their heirs, Executors, and administrators, etc., whereas settler
of the Trust are possessed of and Otherwise well and sufficiently
entitled to the sum of Rs. 1,000/- (Rupees One Thousand only)
hereinafter referred to as said property.

Whereas the Founders of the trust are desirous of creating a public


charitable trust with a motive to serve the society at large by
DEMOCRATIC INDIA FOUNDATION, will be firmly committed to the public
interest and democratic values. Apart from providing authoritative
analysis and commentary, the aim, as our resources grow, is to build
ourselves as a platform driven by good old-fashioned reporting on
issues of national and international importance and interest. Being on
the web also means using new media technologies to change the way
stories are told. With data and interactive charts, video and audio as
integral parts of the narrative structure when warranted.
NOW THIS DEED OF DECLARATON WITNEESETH:

1. The name of the trust shall be as “DEMOCRATIC INDIA


FOUNDATION”. The trust office presently shall be at, - Flat No-
A-36, Senior citizen society,Pocket-4,Greater Noida-
210308(u.p). However, the founders may change it from time to
time on the basis of majority decision. The term Trustee shall
mean the trustees of the said “DEMOCRATIC INDIA
FOUNDATION”.

2. OBJECTS / GUIDELINES OF THE TRUST ARE:

To spread basic literal,vocational,commercial,technical,social,moral


computer,medical,adult,digital education through Journalism by
Means of electronic,digital,print Media

To confer title award, acknowledgement and recognition to


individiual,organizations,,entities whether registered or unregistered
for their outstanding contribution in various fields such as Media,
Social science, Skill development, Technology ,Women empowerment,
Health and sanitization,Environment protection and
development,Literature,Education,Science,and sports etc.

To award scholarships and fellowships in cash or in such other


forms,pay tution fees, examination fees, boarding and lodging fees to
deserving students and to supply books free of cost to such students on
such term and conditions as the trustees may think fit for the purpose
of undertaking, pursuing and encouraging studies provided that such

scholarships and fellowships shall be awarded to such poor and/or


deserving students and scholars studying in
schools,colleges,universities,and other educational institutions in India
or abroad and who can not afford and have no means to prosecute the
same.

To make awareness among the masses about and take necessary steps
to protect the Democracy and Rights of Citizen of India

1. To work closely with public bodies,corporation,private


organization,literal and cultural agencies for co-planning,designing
and management of programmes to protect or reserve the Right of
citizen of India and work in for defend and protect their right, by
using legal justice and public pressure through media ,petitions etc.

. 6. To establish, maintain, conduct, provide, procure or make available


services of every kind globally including commercial, statistical,
financial, accountancy, medical, legal, management, educational,
engineering, data processing, communication and other technological or
social services

To establish, provide, encourage, maintain, conduct, do research and


development activities including multimensional activities and such
other tests, studies, thesis, investigations, inventions and improvements
or information technology which is likely to assist any Aim of the
Trust and for industrial use in general

To buy or to take on lease plot or plots of land and to construct flats,


office, houses, bungalows, cottages, factories, warehouses, shops, shed,
barns, farms, stables, areas, work and conveniences of all kinds thereon
for allotment to the members of the Trust for their authoirsed use.

To secure, promote, organise, manage or enter into joint venture


agreement, collaboration, agreement in all its branches with any person,
firm, Trust, corporation, authority, body or other entity in India or
abroad for any purpose whatsoever.

To Invest surplus funds of the Trust in all kinds of securities, shares,

stocks, debentures, debenture-stocks, bonds, real estate and to finance


industrial enterprises.

To make and/or receive donations, gifts or income to or from such


persons, institutions or Trusts or Public/private Trust and in such cases
and whether of cash or Online
any other assets as may be thought to benefit the Trust or any other
objects of the Trust or otherwise expedient and also to remunerate
any person or corporation introducing or assisting, in any manner the
business of the Trust

convicted person in the society .
13)To help self-help groups,start-ups either man/women ,create job opportunities for
them ,provides finances mentoring ,get financial aid for them tie up with bankers for their
finance and advance their objective of self-help.
14) To conduct ,take up and carry out researches,advocacy,planning and evaluations
On priorities issues and critically examine and assess existing policies systems and
programmes so as to formulate cohesive alternative strategies for optimum accrual of
benefits to the targeted masses.
15) To appoint and supervise paid staffs for the organization and to set up branch
/*offices,purchase/acquire land on lease in the name of organization in suitable places
In rural,hill,towns etc of the country.
16)To accept donations or raise subscriptions from members of the board of trustees, trust
and to invest the funds further for the fulfillment the aims and objectives of the trust.
17)To do such things/acts/activities which are necessary and may be incidental for the
fulfillment of cause or objectives of the trust,as may be required.

1) To own, undertake, manage, acquire and carry on business of publishing


books, periodicals, journals, magazines, periodicals, newspapers, pamphlets

and other literary works and the like either as owners, or lessors etc.

1A. To carry on the business of transmission and broadcasting, telecasting,

programming, audio-visual, production & marketing of audio-visual software

like music cassettes, soap operas, serials, information & entertainment based

programmes and all types of work related to electronic media information and

technology and mass communication, software development and provision of

I.T. related consultancy and other services.

1B. To have an internet website, offering web based facilities like e-commerce, emailing &
electronic information services etc.

1C. To undertake and carry on the business in India and elsewhere of event

management, outdoor advertising activity, producers and providers of contents

and information in all its kinds, forms and description including digital,

electronic, analogue, internet, radio and mobile phones and to provide other

allied services and carry on allied activities

3. To carry on all or any of the business of printers, publishers, stationers,

lithographers, typefounders, stereotypers, electrotypers, photographic printers,

photolithographers, chromo-lithographers, engravers, diesinkers, bookbinders, designers, card


printers, calendar printers, translators, papers and ink

or the stationery goods manufacturers, book-sellers engineers, contractors

and dealers in or manufacturers of or importers and exporters of any other

articles, goods, finished or unfinished or other things of a character or kind

similar or analogous to the foregoing or any of them or connected directly with

them.

4. To collect, supply and disseminate, inform or open information to employ

correspondents, authors, writers, and others and to pay for news information,

caricatures, articles, copy-rights of publication, and translation and other rights

in respect of any literary, scientific, artistic or other matter and to publish the

same or to dispose of the same, to act as agents or contractors to investigate

or enquire into any matter or occurrence, to sell intelligence, information or

tender advice on payment or otherwise in matters, financial, legal, scientific,

commercial, sociological or religious.

5. To establish competitions in respect of anagrams, cross-words etc. or suitable

for insertion in any publication of the Trust to hold or promote

competitions of any description authorised by law, which may be calculated to

enhance or increase the business of the Trust or may be beneficial to the

Trust or to advertise or promote the sale of any publication of the Trust

or of any other person and to suffer and give prizes, rewards, compensations,

and premia in connection with such competitions or otherwise and to give

scholarships, privileges, advantages, rights, bonuses, or reward of any other

kind whatsoever for the purpose of the Trust and on such terms as the

Trust may deem fit.

6. To manufacture goods, articles, printing materials, appliances and other

apparatus or machinery which may be used for the Trust or in connection

with any other business which the Trust may be entitled to carry on.

7. To work printing, press, and allied machinery either by hand, oil, steam

electricity, motor, mechanical or any other power newly invented or found or

otherwise and for the purpose thereof, to construct, erect, lay down, establish,

fix and carry out all necessary cables, wires, lines, lamps and works and to

generate, produce, accumulate, store, distribute and use electricity for the

purpose of light, heat, motive power or otherwise.

8. To purchase or otherwise acquire, either wholly or any part and to print

publication, edit newspapers, magazines, pamphlets, journals, dailies,

reviews, pictorials, annuals, supplements, bioghraphies, autographies, books,

treatises, pictures, circulars, encyclopaedias and other literature or works and

publications and to carry on business as bill posters and to deal in pictures,

photographers, autographers, paintings, pictorial post cards, calendars,

diaries, stationery, artistic goods, artistic materials and to act as picture frame

makers, photographers, artists, sculptors, painters, decorators, circulating

library keepers.

9. To purchase, acquire take on lease, or in exchange or in any other lawful

manner any area, land, buildings, structures and to turn the same into

account, develop the same and dispose of or maintain the same and to build

townships, markets or other buildings, or conveniences thereon and to equip

the same or any part thereof with all or any amenities or conveniences,

drainage facility, electric telegraphic, telephone, television installations and to

deal with the same in any manner whatsoever.

10. To sell, exchange, let on lease or on hire or otherwise dispose of or grant

rights over the whole or any part, of the real, personal, moveable and

immoveable property of the Trust on such terms as the Trust shall

determine.

11. To design manufacture, assemble, contract for, buy, sell, let out on hire and

generally deal in any plant, machinery , tools, goods or things or any

description which in the opinion of the Trust may be conveniently dealt

with by the Trust.

12. To apply for and take out, purchase, or otherwise acquire any designs, trade

marks, patents, patent rights or inventions, copyright or secret processes.,

which may be useful for the Trust‟s objects and to sell, or otherwise

dispose of any designs, trade marks, etc., or to grant licences to use the

same.

13. To open an account or accounts with any bank or banker and to draw and

endorse cheques and to withdraw moneys from such accounts.

14. To draw, accept, make endorse, execute, discount and negotiate bills of

exchange and promissory notes and the negotiable instruments.

15. To borrow or raise money by the issue of debentures (perpetual or

terminable), bonds, mortgages or any other securities founded or based upon

all or any of property and rights of the Trust, including its uncalled capital

or without any such security and upon such terms as to priority or otherwise,

as theTrust shall think fit.

16. To receive money on deposit or loan for the purpose of financing the business

of theTrust upon such terms as the Trust may approve and to

guarantee the debts and contracts provided that it will not be repugnant to the

Banking Companies Act.

17. To advance and lend money upon such security as may be thought proper or

without taking any security therefor.

18. To invest the moneys of the Trust not immediately required in such

manner, as from time to time may be determined

19. To enter into any contracts, agreements and arrangements with any

Government or authorities or any other Person/Body which may seem

conducive to the Trust‟s objects or any of them and obtain from any such

Government or authority any rights, privileges and concessions which may

appear desirable to be obtained, to carry out, perform and comply with any

such contracts, agreements, arrangement rights, privileges and concessions.

20. To purchase or otherwise acquire all or any part of the business, properties

and liabilities of any Trust, association of persons, society, partnership or

persons formed for all or any part of the purposes within the objects of this

Trust and to conduct and carry on or liquidate and wind-up any such

business.

21. To acquire by subscription, purchase or otherwise and to accept and take,

hold and sell, shares or stock in any Trust, Society or undertaking the

objects of which shall either in whole or in part be similar to those of this

Trust.

22. To expend any of the moneys of the Trust in exhibiting or otherwise

advertising or making known the business and products of the Trust and

to make any arrangements for the payment of commission or shares of profits

to or otherwise remunerating any person or Trust advertising or making

known such business.

23. To establish agencies in India and elsewhere and to regulate and discontinue

the same.

24. To provide for the welfare of persons in the employment of the Trust or

formerly in the employment of the Trust or its predecessors in business

and the wives, widows and families of such persons, by grants of money,

pensions or other payments and by providing or subscribing towards places of

instruction and recreation and hospitals, dispensaries, medical and other

attendance and other assistance as the Trust shall think fit and to form,

subscribe to or otherwise any benevolent, religious scientific, national,

Educational, Hospitals, Dispensaries, Homes for infirm, invalid or Blind or

other institutions or objects which shall have any moral or other claims to

support or aid by the Trust by reason of the nature or the locality of its

operations or otherwise, but not forming part of any Political donations.

25. To provide for all and or any employees of the Trust any special benefits,

privileges or advantages by way of sharing in profits of the Trust or

otherwise and generally to carry out such schemes for profits sharing or any

other benefits to employees as may seem desirable.

26. To establish competitions in respect of contributions or information suitable for

insertion in any publication of the Trust or otherwise for any of the

purposes of the Trust and to offer grants, prizes, rewards, and premiums

of such character and on such terms as may seem expedient. But no

contributions will be made to Political parties.

27. To accept stock or shares in or the debentures, mortgage, debentures or other

securities of any other Trust in payment or part payment for any services

rendered or for any sale made to or debt owing from such Trust.

28. Subject to the provisions of of theTrust Act, to distribute in

specie or otherwise as may be resolved any assets of the Trust among its

members and particularly the shares, debentures or securities of any other

Trust formed to take over the whole or any part of the assets or liabilities

of this Trust.

29. To employ, remove or suspend or enter into agreements with such technical

experts, officers, managers, secretaries, clerks and others as may be deemed

expedient and to remunerate them in any manner desirable for services

rendered or to be rendered to the Trust.

30. To enter into and carry into effect any arrangement for joint working or for

sharing of profits or for amalgamation with any other Trust, association of

persons, or any partnership or person carrying on business within the objects

of this Trust or not.

31. To establish, promote and otherwise assist any Trust or companies,

partnership, associations of persons, societies, for the purpose of acquiring

any of the property or further any of the objects of this Trust.

32. To undertake and execute any trust the undertaking of which may seem to the

Trust desirable either gratuitously or otherwise and or to establish schools

colleges and or to organise lectures and symposiums etc.

33. To pay all or any costs, charges and expenses whatsoever preliminary

incidental or relating to the promotion, formation, registration or establishment

of this or any other Trust and to remunerate by commission, discount or

otherwise, any person or Trust for services rendered in placing or assisting

to place the debenture, stock or securities.

34. To spend money in any way deemed fit with the view to improve the value of

any business or property of Trust or otherwise directly or indirectly

advancing its interest.

35. From time to time to subscribe or contribute to any charitable, benevolent or

useful object of a public character, the support of which will, in the opinion of

the Trust, tend to increase its repute or popularity among its employees,

its customers or the public.

36. To refer to arbitration and to bring, conduct, defend, compromise and abandon

legal and other proceedings and claims by and against the Trust or

concerning its affairs.

(B) OTHER OBJECTS TO THE TRUST ARE :

1. To build, take on lease, purchase or acquire in any manner whatsoever any

apartments, houses, flats, rooms, huts, or other accommodation for men or

animals and to let or dispose of the same on instalment basis, rent-purchase

basis, or by outright sale whether by private treaty or by auction, or in any

other mode of disposition all or any integral part thereof.

2. To purchase or otherwise acquire, issue-re-issue, sell, place, underwrite and

deal in shares, stocks, bonds, debentures and security of all kinds.

3. To acquire any movable or immovable property, which theTrust may think

desirable to acquire by way of investment or with a view to resale or otherwise.

 To educate people, disseminate information and knowledge


related to above areas of work, public health policies, social
legislations, social security net, livelihood and governance
related matters through newspapers, periodicals,
newsletters, manuals, handbooks, case studies, research
papers, websites or other forms of publication as is
necessary through all forms of publication as is necessary
through all forms of media by itself or in collaboration.
 To coordinate and collaborate with organizations or
individual, national and international in the board areas of

work and create a network and/or partnerships for


knowledge sharing.
 To undertake and provide consultancy studies to any
person, institution, government and non-governmental
organization in the board area of work.
 To raise resources from public, government and non-governmental
agency etc. to sustain its activity mission and vision.
 To organize and conduct workshops/seminars and training for the
communities, public health personals, media and other civil society
groups.
 To work as a resource centre for other organizations and people.
 To develop resource centres, informal educational centers and
documentation centers that would promote public health education
and related activities the scope of work being within India and
abroad.
 To facilitate inclusion of women in governance at community and
village level.
 To facilitate access to government programmes and schemes for
women.
 To facilitate inclusion into financial systems, healthcare, education
and food programme.
 To encourage and support micro entrepreneurship.
 To encourage women’s literacy.
 To organize community outreach programmes for youth and
women.
 To empower tribal women and community through livelihood
programme.
 To facilitate last-mile connectivity for community and other
organizations for rural development and innovations.
 To channelize the sense of responsibility and efforts of those who
want to contribute in the fields of education, medicine and welfare
of needy people.
 To spread education and for achieving the said object to establish,
maintain, run, develop and improve, extend, grant donations in
cash and kind and assist in the establishment, maintenance,
running, development, improvement and extension of schools,
colleges, workshops, industrial and technical schools, institutions
for the promotion of the agricultural farms for the benefit of the
people.

 To work for the advancement of education, Art, science, social


sciences, humanities and religion.
 To establish, maintain and run academics, training centers,
guidance and coaching bureaus, etc with special case of women.
 To launch campaigns for mass awareness in educational, social,
economic and cultural lives of people.
 To organize orientation courses for teacher’s administrative staff,
educational activities, text book, and children’s book writers, etc.
 To inform and instruct youth and students in vocational courses
about career opportunities;

 To organize meetings, seminars, conferences, workshops etc; and
utilize media for dissemination of knowledge and information and
inculcation of an enlightened outlook and moral values among the
people.
 .
 To publish research reports, Translation works and other books of
high academic standards.
 To publish educational, non-formal and religious books and to
distribute the same amongst the poor students either free or at
occasional rates.
 To establish, maintain, support or contribute or institutions or funds
providing relief in general to people who are poor and in distress
and in particular to hospitals, dispensaries, nursing homes,
asylums, orphanages, dharamshalas or other such charitable
institutions.
 To carry on such further charitable objects if general public utility
as are compatible or in consonance with the objects of the trust.
 To improve cultural educational and social condition of the people,
undertake Multidisciplinary programs and work for democracy.
Good governance, realization of human rights, international peace.
Justice and cooperation including NGOs cooperation and
coordination programmes.
 To provide legal aid to the socially disadvantaged groups. Old aged
senior citizens. Minority, tribal, dalit,, backward, abused women,
landless laborers and protect and Support their interest including
prevention of communal riots.
 To create awareness against corruption and help the people to
raise legal demands and fundamental rights provided by

'Constitution of India' and take up effective but reasonable and


lawful steps for the eradication of corruption in the society.
 To communicate with the Government, local and public authorities
regarding the problems faced by the people in connection with
water, electricity and road safety and protect their interest.
 To support and / or oppose and take necessary action including
legal recourse to represent, defend and support / oppose any such
move. Legislation, taxation or other concerned measure, imposition
or enactment for the protection of legitimate rights, interest and
work of general public.
 To assist the public in setting their disputes with the Government
and public authorities arising out of commercial transactions and to
set up panels of arbitrators and to enforce decisions.
 To collect and obtain all information, on matters affecting the
general public, make representations to the various authorities
including public schools in connection with the donations collected
at the time of admission and to appear before any authority in the
interest of, protection and betterment for the general public.
 To undertake, manage and promote crime investigating team,
investigate crime and approach the competent court/ courts to
safeguard the rights of the general public and for the public
interests from time to time as the Trust may deem fit and proper.
 To develop a database of the Voluntary consumer organizations in
the region and consumer related information such as relating to fair
price shops, availability of essential Commodities etc.
 To organize all important functions relating to consumer awareness
generation such as World Consumer. Day and to interact with the
student community in the schools in the Zila Parishad region.
 To organize seminars l workshops / conferences and meetings from
time to lime to monitor the future activities of consumers and
provide solution to the practial problems being faced by the
consumers.
 To undertake, promote, propagate, encourage and manage
cultivation of medicinal plants used in the manufacture of
Ayurveda,Siddha, Unani & Homeopathy systems of medicine which
is speedily shrinking day by day.
 To establish residential school especially for girls to raise
educational status of women belonging to educationally backward,
minorities and promote a concept of technical education 'among
the educationally backward Minorities.

 To provide financial assistance for remedial coaching and hostel


accommodation for girls students from educationally backward
sections of society.
 To provide basic educational infra-structure and facilities in the
areas of concentration of educationally backward minorities which
do not have adequate provision for elementary and secondary
schools?
 To undertake the programs of women empowerment, strengthening
of boarding and hostel facilities for girls. Family counseling,
capacity building, self employment and removal of gender
discrimination.
 .
 To fill the gap of economic divide between poor and rich undertake
the programs of Poverty eradication, vocational training, tribal and
indigenous people development including community based
rehabilitation.
 To undertake intensive research, training and development
programs of science and technology, low cost technologies,
including the job of generation, distribution, utilization,
conservation and transformation of non-conventional source of
energy.
 To undertake and arrange for publishing booklets, articles and
books for promoting Human values, process documentation, media
advocacy and educate people through hoardings, advertisements,
exhibitions and seminars.
 To motivate and organize people for creating awareness against
unscientific, inequitable, unjust, unfair values resulting in slowing
down human development and promote qualities such as
resourcefulness, initiative and self reliance.
 To distribute scholarship, books, stipends, medals and other
incentives to meritorious students of the underprivileged sections
of the society and create sense of brotherhood, cooperation, mutual
harmony, love and affection amongst the general public.
 To undertake protection and promotion of cultural and natural
heritage, develop strategy_ for promotion of tourism by
conservation of tangible and intangible heritage and thereby
increasing the employment potential and eradicating poverty.
 To provide integrated community based non institutional basic
services for the care, protection and development of street
children, child labor, distressed women, disadvantaged youth

including teens, parents and their children facing destitution,


neglect, abuse and exploitation.
 To undertake training in computer and information technologies,
conversion of traditional Indian languages in multinational
languages and accordingly software development including
promotion of indian modern languages, Persian, Arabic and other
foreign languages.
 To run, manage, conduct, sponsor, coordinate, control and organize
programs/ research specially related to the enlistment of disabled,
their education and rehabilitation with a holistic and progressive
approach under the various schemes of concerned
authorities/government.
 To provide assistance to the physically handicapped children in
respect of artificial limbs and to give them vocational training on
different technical/non-technical/professional / industrial and on the
other subjects/fields which will make them independent.
 To provide consultancy to the State Government and voluntary
organizations, working for rehabilitation of handicapped/mental
handicapped/physical handicapped/mentally retarded with autism,
cerebral palsy and multiple disability.
 To take up effective, reasonable and lawful steps for the solution of

and also to promote the use of the products of Artificial Limbs
Manufacturing Corporation of India.
 To provide total care to persons with mental retardation with
autism, cerebral palsy and multiple disability and also to manage
the properties bequeathed to the trust and undertake vocational
training and placement assistance.
 To enable and empower physically handicapped to live as
independently and as fully as possible within their own families and
facilitate the realization of equal opportunities and full participation
of persons with disabilities.

 To provide legal aid, counselling, care, protection and rehabilitation


to the females allured, married and cheated/abandoned by their
NRI husbands and conduct seminars and Workshops to aware
young marriageable grids and their parents to gather complete
information about the groom and his family staying abroad before
marriage.
 To work for the welfare of artisans, crafts persons, weavers and
those people who are working in the field of handicraft and cottage
craft at various places in India.
 To work for the rights of the children, women, widows, artisans,
crafts persons, weavers and to help them in issues related to their
health, education, employment and income generation.
 To Endeavour to redress the grievances of the members by all
amicable means and within the frame work of our constitution.
 To Endeavour to seek justice for its members on matters related to
education, health, employment, environment, food & nourishment,
art & craft, agriculture And well being.
 To generate employment opportunities and ensure remunerative
earning for women, crafts persons, artisans, weavers, unemployed
and destitute.
 To open vocational training cum production centers for the
rehabilitation of orphans, widows and unemployment persons,
besides enhancing the skill of artisans, craftsmen and weavers.
 To establishes centers for senior citizens to take care of the old
and infirm.
 To open craft development centers and design development
centers for the weaker sections of the trust to promote traditional
Indian handicrafts.
 To facilitate development of market and realization of remunerative
prices for handicrafts, art wares, textiles, natural, organic and
agricultural products. To undertake price support operations
whenever feasible and possible.
 To spread awareness about quality and quality up gradation of
traditional Indian cottage crafts, handicrafts, textiles, natural,
organic, agricultural and horticultural products to maximize unit
value realization.
 To establish out lets for artisans, craftsmen, weavers and farmers
to help access the market in the metropolitan & urban centers and
abroad.

 To conduct exhibitions, crafts bazaars, fairs, product awareness


workshops, buyer‘s sellers meet festivals and urban hats at the
national, state, local and international levels.
 To invite marketing, design and technical consultants for promotion
of Indian handicrafts, textiles, art wares, natural and organic
products at national and international level.
 To promote self reliance and independence among the educated
unemployed, women, rural persons, artisans, crafts persons and
farmers by organizing training programs on entrepreneurship,
product selection & development, quality, packaging and marketing
of healthy food, agro products, Ayurveda & naturopathy products,
textiles, art wares and handicrafts.
 To ensure sustainable development through production and
marketing of natural &organic agricultural produce, herbs, spices,
pulses, dry fruits, cereals, fruit & vegetables, medicinal& aromatic
plants and their products.
 To open schools, libraries and hostels, vocational training centers,
product design & development centers, common service centers for
all the deserving sections of the trust.
 To provide full range of services relating to collection, storage,
transportation and marketing of healthy food, natural & organic
products, agro products, textiles, handicrafts, art wares and all
other allied products.
 To take grants, loans, donations, gifts etc. from government,
private agencies, individuals and trusts at the national and
International level for the welfare of old people, women, children,
unemployed, under privileged, weavers, artisans, craft persons and
farmers.
 To publish books, Charts, illustrations, journals, magazines,
periodicals and other publications for the benefit and welfare of the
trust.
 To work for the Welfare of women and children, unemployed, old &
infirm, dependents of craft persons, weavers, artisans, farmers and
under privileged.
 To associate with similar organizations.
 To conducts charitable services for needy people.
 To promotes and support sustainable livelihoods among
rural/urban/tribal poor and women in the country and international
level to help them achieve a better quality of life.

 To imparts education and promotes literacy to all deserving


sections of trust in a congenial environment to build a strong
nation.
 To inculcates a spirit of unity and to shape enlightened responsible
citizens through such educational institutions.
 To organize seminars, For BPL Families Training, Awareness,
income generate Programmes and workshops on relevant issues
and to co-operate and associate with similar organizations.
 Member of our trust always consider as young even they are of any
age.
 To perform all such acts as may be necessary for the achievement
and accomplishment of the above mentioned aims and objectives
and allied social activities and services. All the incomes, earnings,
moveable and immoveable properties of the trust shall be solely
utilized for the promotion and implementation of its aims and
objectives only as sort forth in the memorandum of association and
no profit thereof shall be built or transferred directly or indirectly by
way of dividends, bonus, profits or in any manner whatsoever to the
present or past members of the trust or to any person claiming
through anyone or more of the present or the past members. No
member of the trust shall have any personal claim on any movable
or immovable property of the trust or make any profits whatsoever
by virtue of his/ her membership.

3. PROPERTY VESTED IN THE TRUSTEES

The Trustees hereby transfer the sum of Rs. 1,000/-(Rupees One


thousand only) each in favor of the Trust. The above said amount shall
be their initial contribution. The Trustees shall hold the said fund and
other properties that may be endowed or conferred for the said Trust
for the use and benefit of the Trust. The Trustees shall, out of the
income realized from the properties endowed and such other
endowments or donations, which they may get, pay all taxes and rates,
where applicable, and all expenditure connected with the trust. Where
such income is insufficient to meet the expenses, the trustees may use

such portion of the corpus of the Trust fund for the purpose, as may be
found necessary and where the income of the Trust exceeds the
expenditure of the Trust, such excess may be added to the Trust fund.

The Bank A/c. of Trust shall be operated by the Any Three Author jointly
duly authorized by Board.
BENEFICIARIES OF THE TRUST
The trust is established for the benefit of citizens of india and the class of
people mentioned above without discrimination of caste,religion,creedor
sex.
PROPERTIES

Any cash ,kind,properties,movable and immovable that may be acquired by


purchase or otherwise or all manner of rights,title, or intrest in or over any
property movable or immovable
All additions and accretions to the trust properties and the income there from

The properties of trust shall be utilized for the objects set forth herein above
and subject to provisions and herein mentioned.
NUMBER OF TRUSTEES,THEIR TERM AND POWER TO CO-OPT
The trust will be managed by a Board of trustee consisting of not less than 4 trustees and not
more than 11 trustees.The parties of the second part will be first trustees and they shall
automatically from the board of trustee.

The first Managing Trustees shall be SETTLOR and he will hold office for his life time.
After the demise or relinquishment of office of the managing trustees or in the event of
the first Managing trustees nominate his successor in office.

The Trustee who are not First managing trustees may retire from the trust ship hereof by
giving Three calendar months notice in writing of his or her intention to do so to the
Board of trustee and after the expiry of the period of notice the Trustee giving the notice
shall ipso facto cease to be trustee of these presents.

The term of office of remaining first trustees shall be for their respective lives.
The board of trustee shall have power to increase the total number of trustee upto the
maximum number stated above and fix their term as per provisions contained herein .

The trustees who are not First managing trustees or first trustees shall hold office for a period
of one year from their date of appointment by the trustees. At the end of this one year
period ,the Board of trustees may reappoint them for subsequent term or appoint other
persons as Trustees in such a manner that the total number of trustees does not exceed
the approved maximum number of trustees.

The Managing trustee shall have the power to remove a Trustee suffering from physical
mental disability or if he is accused of misfeasance of trust funds or property or
misconduct

Eligibility to Become a Member.


Entities eligible to become a Member of Trust are: any city, town, county, school district, chartered
public school, village district, school administrative unit, or any district or entity created for a
special purpose administered or funded by any of the above-named governmental units, and
which is located in and authorized by any govt. body or any individual or citizen of india or
NRI.
. Requirements to Become a Member of Trust.
Prior to becoming a Member of Trust, an entity must:
(a) Complete an Application and Membership Agreement or such other written request to become
a Member as the Board of Trustees shall determine;
(b) Meet all other criteria established and provide all information requested by Trust which it
deems necessary and prudent;
Acceptance as a Member of DIF Trust.
The Settlor has the authority to accept any entity which meets the criteria set forth and to terminate,
without any notice

TERMINATION OF OFFICE OF THE TRUSTEES:


(a) Trustee shall cease to hold office: i) if he dies, ii) if he resigns, iii) if he is adjudged
insolvent or found guilty of an offence involving moral turpitude. iv) if he is found to have acted
against the interest of the Trust. v) if it is unanimously decided by the Trustees specified in para(4)
above that his continuation in the Office is against the interest of the Trust. vi) Upon expiry of the
period up to which the Board of trustees have nominated the trustee.
MEETING AND PROCEEDINGS OF THE TRUSTEES:
The Trustees shall ordinarily meet once in __Three______months or as often as may be
necessary for the satisfactory conduct of the affairs of the Trust.
NOTICE:
__15_______days Notice shall ordinarily be given in writing for a meeting of Board of
Trustees.
QUORUM:
The Quorum for the Meeting of the Board of Trustees shall be _______numbers quorum is
required for a meeting adjourning for want of Quorum. A minute book shall be kept by the Managing
Trustee. Minutes of entry into the office of every new trustee and of all proceedings of the meeting of
the 5 board of trustee shall be entered in the minute book and shall be signed by the President of the
Meeting.
VOTING:
Decisions of the Board of Trustees may be made at a meeting or by circulation of papers to
them. Normal matters of routine nature may be circulated and decision obtained. The important
matters are to be decided at the meeting. All matters arising for disposal shall be decided by a
majority of the Board of Trustees or SETTLOR present at the Meeting.

BOOK ACCOUNT:
(i) The Board of Trustees may open such Bank Account or Accounts in any of the Banks in
the name of DEMOCRATIC INDIA FOUNDATION Trust such accounts shall be jointly operated
by any three of Managing Trustee.
(ii) The trust may open Bank Account/s in the name of institution/organisation founded by
the Trust. Such Bank Accounts shall be operated by such persons as authorised by the board of
trustees from time to time.

ACCOUNTS:
The Trustees shall maintain a true and correct record of the receipts, payments incomes and
expenses and transactions of the Trust. The Books of Account of the trust shall be audited by a
qualified auditor or a Chartered Accountant every year i.e., commencing from 1st April to the 31st
March of next year.
DEFECTS OF PROCEDURE IMMATERIAL:
No act of Trustees shall be invalidated by reason only of any vacancy in the Board of
Trustees or any irregularity in the proceedings of the Board of Trustees or any Committee thereof.
AMENDMENTS:
No amendments to the Trust Deed shall be made which may prove to be repugnant to the
provisions and 80G of the Income Tax Act, 1961 as amended from time to time.
DISSOLUTION:
In the event of dissolution of winding up of the Trust the assets of the trust remaining on the
date of dissolution shall under no circumstance be distributed among the Trustees, but the same shall
transferred to other Trust, Society, Association or Institution whose objects are similar to those of
this Trust.

4. BOARD OFTRUSTEES

(a) The Board of Trustees shall comprise the founding Trustees. The
founding Trustees shall hold Office for life. However any trustee may
resign by giving notice in writing to his/ her co trustees. Appointment
of trustees, either to fill up a vacancy or as additional trustees, shall
be by resolution of the founding trustees.
(b) The trustees hereby declare that they for time being, we hold the
said sum and all gifts, contribution, subscription, donations, bequests
and other moneys or property as and when the same shall be paid to

or vested with them as the moneys, investment and property from


time to time representing the same upon trust of object of general
public utility not involving the carrying of any activity for the profit or
for charitable purposes which tends to promote human welfare,
providing however no part of the funds or income thereof be applied
to any purpose outside India except in accordance with the approval
with Central Board of Revenue, government of India and for such
purpose, as defined in objects clause (2)above.

5. POWER & DUTIES OF BOARD OF TRUSTEES

a) To apply, the whole or part of the income or accumulation thereof or


whole or part of the corpus of the Trust properties for one or more of
the objects of the Trust as outlined in clause (2) above or as the
Trustees may from time to time determine.

b) To convert and get in the Trust property and/ or vary the


investments for the time being and to invest and keep invest the Trust
properties either in the purchase or mortgage of immovable properties
or in shares, debentures or other securities/ investments and to alter,
vary or transpose such investment from time to time as the Trustees,
shall in their absolute discretion think fit. Provided, however, that
accumulations of the income of the Trust properties, in respect of
which notice has been given to the assessing officer under section11
(2) (a) of the Income-Tax Act 1961, shall only be invested in
accordance with section11 (2) (b) the Act.

c) To let or demise any immovable property comprised in the trust


fund for such rent, on such terms and conditions, as the trustees in
their absolute discretion shall think fit.

d) To open account in the name of the Trust, with any Bank or Banks
and to operate such account(s) and to give instructions to the bank
and to provide for opening and operation of such account by the
Author and any of the trustees jointly duly authorized by Board. To
adjust, settle, compromise, compound, and refer to arbitration all
actions, suits claims, demands and proceedings regarding the trust
properties.

e) To appoint constituted attorneys or agents and to delegate to such


attorney or agents all or any of the powers vested in them under these
presents from time to time and remove such attorneys or agents and to
appoint other or others in his or their place.

f) To appoint or make provision for the appointment of any persons


(s) (including all or any of the Trustees) as committee or
administrator or managing Trustee or otherwise for the purpose of
the administration of the trust, in such manner and subject to such
rules and regulations as the Trustees may prescribe.

g) To make, vary, alter or modify schemes, rules and regulations for


carrying out the objects of the Trust and for the management of the
affairs thereof and of running any institutions in furtherance of the
objects of the Trust and otherwise for giving effect to the objects to the
Trust.

h) To set apart to whole or part of the income or the corpus or part


thereof for any of the objects of the Trust.

i) The Trustees shall be chargeable only for such moneys, stocks,


shares and funds, as shall actually come into their hands and shall not
be answerable for neglect, default, acts of omission or commission of
the other Trustees or of any banker or default, acts of omission or
commission of the other Trustees or of any banker or other person with
whom, the Trust properties and securities may have been deposited or
handed over, unless caused by their will full neglect or Defaults’.

j) The receipt of a person authorized by the Trustees or a resolution


of the Board of Trustees for any moneys paid or any property
transferred or delivered to Trustees in execution of the Trust or
powers.

k) The Trustees will not be entitled to receive any remuneration as


Trustees, but may reimburse themselves of all expenses actually
incurred by them in connection with the Trust or their duties thereto.

l) No Trustee shall refuse to be Chairman of the Board of Trustees,


unless he/she shows his resentment to act as Chairman for a specified
or unlimited duration. The Chairman shall be entitled to call the
meeting of the Board of Trustees and preside over the meeting. The

Board of Trustees may from time to time frame all other rules for the
conduct of the administration of the Trust and regulating the meeting of
Trustees, which are not covered in this deed. In the absence of such
regulations: Majority will decide all matters and two Trustees shall form
a quorum for meeting of Board of Trustees.
m) Resolution passed without any meeting of the Board of Trustees
and evidenced in writing under the hand of two thirds of the Trustees
shall be as valid and effectual as a resolution duly passed at a meeting
of the Board of Trustees.

n) Proper Books & Accounts shall be maintained by the Trust and shall
be audited by an independent firm of chartered accountants.

o) The Trustees shall maintain the minutes book, in which the


proceedings of all meetings of Trustees shall be recorded by the
Trustees and the Chairman of the meeting shall sign the same.

6. CUSTODY OF DOCUMENTS
The Chairman or his/her nominee or any other Trustee, if so authorized
by the Board of Trustees, shall have the custody of all the documents,
deeds of title, relating to the Trust properties and investment, and the
books of account and the other record relating to the Trust and shall be
responsible for the preservation of the same.

7. ADVISORY BODY AND CONSULTANT


The Trustee may maintain a set of Advisors for thereof utilizing their
services in furtherance of the objects of the trust.

8. FINANCIAL YEAR
The financial year of the Trust shall end on 31st March every year
provided that the Board of Trustees shall be at liberty to change the
same from time to time if they so deem fit and Proper.
9. ACCOUNTABILITY OF THE TRUSTEES
The Trustees, without prejudice to any other statutory or other right to
indemnification that they may have, shall be jointly and severally
indemnified out of the Trust Fund at all times in respect of each and
every claim made against them or any of them whether in their
capacity as Trustee or Trustees or personally in respect of any liability
arising from or in respect of the Trust, its affairs, administration or
activities or any aspect of any of the same provided always that the

right of a Trustee to an indemnity under this clause shall not extend to


any claim arising from willful fraud or wrongdoing or wrongful omission
or commission on his part.

10. INDEMNITY OF TRUSTEES


a) The Trustees may reimburse themselves and pay and discharge out
of the Trust Fund all expenses incurred by them in or about the
execution of the Trust as specifically authorized by the Trust in the
meeting of the Trustees, or any of their duties under these presents
including travelling expenses, but will not be entitled to receive any
remuneration for the services to be rendered by them as Trustees. The
expenses incurred by them in this regard will be reimbursed to them
only if the same are approved in a meeting of the Board of Trustees.
b) The Trustees shall be accountable only for such moneys,
contributions and funds as shall actually come into their hands and a
Trustee shall not be answerable or accountable for neglect, default, acts
or omission or commission of the other Trustees, nor of any banker or
other person with whom the Trust properties or any securities may have
been deposited or kept for furtherance of any one or more of the
objects of the Trust.

11. UTILIZATION OF TRUST PROPERTY


If the income from the Trust property in a particular year is not fully
utilized, the unspent income, subject to the applicable provisions of the
Income Tax Act, 1961, shall be carried over to the next year or years
and spent in such subsequent year or years for achieving the objects of
the Trust.

12. BENEFITS OF THE TRUST


The Benefits of the Trust activities in terms of the educational, training
and related services it provides shall be available to all Indians,
irrespective of caste, creed, age, sex, or religion.

13. ADDITIONS TO THE CORPUS


The Trust Fund may be added to, by the income from the initial fund
and also by donations and other contributions from time to time.

14. DISSOLUTION OF TRUST

The Trust may be dissolved by mutual and voluntary agreement of the


Trustees. No force or coercion shall be brought about by a Trustee to
bear upon the other Trustee(s) for the purpose of bringing about
dissolution of the Trust. On dissolution of the Trust, all the properties
and other funds of The Trust whether with the Trustees or anywhere
else shall be either utilized in full for the object of the trust or shall be
vested in some other Trust or any other form of public charitable
organization having similar objects.

15. IRREVOCABILITY
It is declared that the Trust is irrevocable. If the Trust fails for any
reason, in the opinion of the Trustees, the net assets of the Trust, both
movable and immovable shall be handed over to any Trust having the
same object, as decided by the majority of the Trustees.
