Dear Mr. Dela Cruz,

SUBJECT: FIRST AND FINAL DEMAND TO VACATE THE PROPERTY LOCATED AT ALANG-ALANG,
BORONGAN CITY

I, Pedro Birhen, the lawful and registered owner of the property located at Alang-alang, Borongan City,
hereby issue this First and Final Demand for you to vacate the property within 30 days from receipt of
this letter.

1. I am the lawful and registered owner of the property, as evidenced by Transfer Certificate of Title
(TCT) No. 011621, which I inherited from my late mother, Dina Birhen, who passed away on April 12,
2015. A copy of the title is attached for your reference.

2. You were allowed to occupy the property temporarily during my mother’s lifetime, based on her
goodwill and our family relationship. This permission was never intended to confer any permanent
rights to you or to grant you ownership or lease of the property.

3. Upon the death of my mother, I became the rightful owner of the property. I have already made
repeated demands for you to vacate, most recently in 2023, but you have refused to comply with these
requests.

4. The continued possession of the property by you is based solely on the tolerance and permission
granted by my mother, and your refusal to vacate, despite my formal demand, has made your stay
unlawful.
As the owner of the property, I hereby issue this First and Final Demand that you vacate the premises
within thirty (30) days from receipt of this letter. If you fail to comply with this demand, I will be forced
to take legal action to recover possession of the property and will seek all available legal remedies.

Please consider this letter as a final notice to vacate the property peacefully and to avoid any
unnecessary legal proceedings.

Kindly govern yourself accordingly.
