PETITION
The undersigned petitioner, ATTY. ADA BONITA TOHAY, unto this
Honorable Court respectfully states:
1. That the Petitioner is a Filipino citizen, single, over twenty-one (21) years old
and a resident of the Philippines for at least one (1) year, continuously
maintains an office at 2/F JD Palma Bldg., Archbishop Reyes Avenue Cor.,
Apitong St., Lahug, Cebu City, Philippines, where she may be served notices
and other court processes, and continuously maintains the following
telephone numbers: (63-32) 231-5901; 231-5892;
2. That the Petitioner was born on March 22, 1991, and presently residing at
Jabonero St., Katipunan, Labangon, Cebu City;
3. That the Petitioner has completed her law studies at the University of San
Jose-Recoletos (USJ-R), Cebu City;
4. That the Petitioner was admitted to the Philippine Bar on May 23, 2017, a
copy of the Certificate of Admission is hereto attached;
5. That the Petitioner has acquired her clearance from the Regional Trial Court
of Cebu City;
6. That the Petitioner has no pending administrative case as evidenced by the
certification issued by the Office of the Bar Confidant which is hereto
attached;
7. That the Petitioner is a bona fide member in good standing of the Integrated
Bar of the Philippines, Cebu Province Chapter and has never been convicted
of any crime involving moral turpitude, attached is a copy of her Certificate of
Good Standing, and has paid her membership on December 6, 2017 as
evidenced by IBP Official Receipt No. 5282 issued by the Integrated Bar of
the Philippines, hereto attached;
8. That as a new lawyer, the Petitioner is exempt from the required Mandatory
Continuing Legal Education as mandated by the Supreme Court during the
given period;
9. That the Petitioner has paid her Professional Tax for the fiscal year 2018
under Professional Tax Receipt No. 8805693 a copy is hereto attached;
10. That the Petitioner has attached herewith and made integral parts hereof her
specimen signatures and the true impressions of her dry seal;
11. That the Petitioner possesses all the qualifications and none of the
disqualifications of a Notary Public;
12. That the Petitioner has not applied for commission before any other
jurisdiction;
13. That the Petitioner undertakes to inform the Executive Judge within ten (10)
days in case of any change in the given address and to submit her monthly
report religiously;
14. That the Petitioner now desires to be granted Notarial Commission as Notary
Public for and in the City of Cebu;
15. That to support this Petition, attached and made an integral part of this
petition are the Following:
a. Three (3) passport size colored photographs of the petitioner as
Annex “A”;
b. Three (3) specimens of petitioner’s signature as Annex “B”;
c. Original Certificate of Membership in the Philippine Bar as
Annex “C”;
d. Original Clearance issued by the Regional Trial Court of Cebu
City as Annex “D”;
e. Original Certificate of No Pending Administrative Case issued by
the Office of the Bar Confidant as Annex “E”;
f. Original Certificate of Good Moral Character issued by the
Integrated Bar of the Philippines, Cebu Province Chapter as
Annex “F”, Clearance from the IBP as Annex “F-1”, and an
original copy of the IBP Official Receipt evidencing payment of
membership dues for the year 2018 as Annex “F-2”;
g. Original copy of the Professional Tax Receipt (PTR) for the year
2018 as Annex “G”;
h. NBI Clearance as Annex “H”;
i. Original Clearance issued by the Municipal Trial Court in Cities
as Annex “I”
PRAYER
WHEREFORE, in view of the foregoing, it is respectfully prayed of this
Honorable Court, after due notice, publication and hearing to grant this Petition for
Appointment of Notarial Commission of the herein Petitioner for and in the City of
Cebu.
Other just and equitable reliefs are likewise prayed for.
