These terms and conditions ("Terms") govern your use of the website at fonix.one (and any domain that redirects to it) and any products or services offered by StreamLink Pty Ltd (ABN 64 615 965 449) trading as Fonix One ("we", "us", "our").
By accessing or using our website, you agree to be bound by these Terms. If you do not agree, please do not use the website.
Kickstarter campaign
Pledges are not purchases
Fonix One is offered through a crowdfunding campaign on Kickstarter. A Kickstarter pledge is a contribution to support the development of the product — it is not a purchase, pre-order, or guarantee of delivery. By backing the campaign, you acknowledge and agree to Kickstarter's Terms of Use, which govern the relationship between creators and backers.
Estimated delivery
Delivery timelines provided on Kickstarter are estimates only. Hardware development involves manufacturing, component sourcing, and quality assurance processes that may cause delays. We will communicate any significant changes to the estimated timeline through Kickstarter updates.
Refunds for Kickstarter pledges
Refund eligibility for Kickstarter pledges is governed by Kickstarter's policies. Before the campaign ends, you may cancel or modify your pledge through Kickstarter. After the campaign concludes, refund requests are handled at our discretion on a case-by-case basis, subject to our obligations under applicable law.
Product specifications
Prototype disclaimer
Fonix One is currently in the prototype stage. All specifications, features, and performance claims presented on this website (including but not limited to battery life, dimensions, supported formats, and storage capacity) are based on prototype testing and are subject to change in the final production version.
Battery life
Battery life claims (e.g., "16+ hours") are based on testing under specific conditions with prototype hardware. Actual battery life will vary depending on usage patterns, Bluetooth codec, volume level, Wi-Fi activity, ambient temperature, and battery age. Final production battery life may differ from prototype results.
Storage
The Fonix One supports MicroSD cards up to 2TB. MicroSD cards are not included with the device unless otherwise specified in your Kickstarter reward tier. Actual usable capacity depends on formatting and the storage medium used.
Software & firmware
Firmware licence
The Fonix One firmware is developed by StreamLink Pty Ltd. The firmware will be made available for free download for users who wish to build their own device using compatible ESP32 hardware. Use of the firmware is subject to the licence terms that will accompany the firmware release.
DIY software unlock
Certain premium software features may be locked on DIY-built devices and can be activated through a one-time payment of $12 USD (or equivalent in your local currency). This unlock is tied to a specific device identifier and is non-transferable and non-refundable once activated, except where required by applicable law.
Updates and support
We intend to provide firmware updates for the Fonix One but do not guarantee the frequency, duration, or availability of future updates. We reserve the right to modify, discontinue, or limit features in future firmware versions.

Acceptable use
You agree not to:
- Use the website for any unlawful purpose or in violation of these Terms.
- Attempt to interfere with, compromise, or disrupt the website or its infrastructure.
- Submit false, misleading, or spam content through any form on the website.
- Scrape, crawl, or harvest data from the website using automated tools without our prior written consent.
Account and submissions
Information you submit through our contact form or newsletter signup must be accurate and current. You are responsible for the content of any messages you send through the website.
Intellectual property
All content on this website — including text, images, graphics, logos, 3D models, software, UI designs, and page layout — is owned by StreamLink Pty Ltd or used under licence. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent, except as permitted by law (including fair dealing under the Copyright Act 1968 (Cth)).
The Fonix One name, logo, and associated branding are trademarks of StreamLink Pty Ltd.
Australian Consumer Law
If you are a consumer within the meaning of the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), our goods come with guarantees that cannot be excluded under that law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right you may have under the Australian Consumer Law or any other applicable law that cannot be excluded by agreement.
Limitation of liability
To the maximum extent permitted by law (and subject to the Australian Consumer Law section above), StreamLink Pty Ltd:
- Provides this website and its content on an "as is" and "as available" basis without any warranties, express or implied.
- Is not liable for any indirect, incidental, special, or consequential damages arising from your use of the website or any product.
- Does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
Where liability cannot be excluded, our total aggregate liability to you is limited to the amount you paid us in the 12 months preceding the claim, or $100 AUD, whichever is greater.
General
Third-party links
This website may contain links to third-party websites, including Kickstarter and social media platforms. We are not responsible for the content, privacy practices, or availability of these external sites. Accessing third-party links is at your own risk.
Indemnity
You agree to indemnify and hold harmless StreamLink Pty Ltd, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the website.
Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the website after changes are posted constitutes your acceptance of the revised Terms.
