JOINT AFFIFAVIT OF WAIVER

I, Luis Cañamales y Seno, 86 years old, with live-in-partner, jobless and


Silveria Cañamales y Encina, 70 years old, with live-in-partner, housewife,
both residents Brgy. Tingib Pastrana, Leyte after having been duly sworn in
accordance with law, hereby depose and say.

1. That I was the grandfather of John Michael Morfe y Cañamares, seven


(7) years old, elementary pupil and a resident of Brgy. Tingib Pastrana,
Leyte;

2. That said John Michael Morfe Cañamares figured in a traffic accident at


about 4:15 o’clock in the afternoon of October 13, 2019 when he was
bumped/hit by a Toyota Hilux pick-up truck colored silver metallic
bearing Plate Number P3D 630, Chassis Number
MR0HA8CD7K1059073, Engine Number 1GD4714387 driven by one
Jessie Borinaga y Rocaberte, 47 years old, married, Motorpool Head of
Mac Builders Corporation and a resident of Brgy. Linao Ormoc City with
Professional Driver’s License Number H03-99033343 which resulted in
our son’s ultimately death;

3. That after the said incident, Jessie Borinaga y Rocaberte and his
brother Danilo Borinaga y Rocaberte did not forsake their
responsibilities and obligations pertaining to our son by paying for the
expenses for the latter’s funeral, wake, burial and grave stone
amounting to ONE HUNDRED SEVENTY-ONE THOUSAND NINE
HUNDRED TWENTY-TWO (Php 171,922);

4. That in view of the above, we are no longer interested in the filling of


any case in court, or in any forum may it be criminal, civil and/or
administrative against the aforesaid suspect and further quit ourselves
in claiming further damages that may arise in the future;

5. That we executed this affidavit to attest the truth of the foregoing and
same was executed in my own freewill and volition and was read to me
in waray-waray, the dialect I understand;

6. That I further say naught.
