AFFIDAVIT OF DESISTANCE

I, JENELYN LOZANO BANOS, of legal age, Filipino, married and a


resident of Kanlunsing_, Tuburan, Cebu, after having been duly sworn to in
accordance with law, do hereby depose and state that—

1. I am the sister of MARY JANE LOZANO who died on 5 October 2022 by


vehicular accident caused by accused ROLANDO CANGMAONG, SARITA, JR;

2. I am , likewise, the private complainant in the above-entitled case;

3. The accused is detained at PNP-Tuburan Police station starting 5 October


2022 up to present;

4. The civil aspect of this case has already been fully settled and by such
reason, we are no longer interested in pursuing the criminal aspect of this case;

5. We are, therefore, voluntarily desisting from further prosecuting the criminal


aspect of the instant case against the accused;

6. I have caused the execution of this Affidavit of Desistance to attest the


truthfulness of the foregoing statement, of my own freewill and volition, solely for
the purpose of seeking the dismissal of the instant case;

7. I therefore signify my intention not further prosecute the same against the
accused ROLANDO CANGMAONG, SARITA, JR _ and by virtue of this
voluntary desistance, I hereby waive in perpetuity all my rights and claims
appertaining thereto.
