AFFIDAVIT OF DESISTANCE
I, AMIL H. TAHA MAPANDI, of legal age, Filipino, and a resident of Brgy.
Lumasa, Taraka, Lanao del Sur, after having duly sworn to in accordance with law,
hereby depose and state that:
1. I am the private complainant in the case of People v. Kinedy “Imao”
Macaayong Manonggiring Riga filed before Branch 8, Regional Trial Court of
Lanao del Sur with Criminal Case No. 8801-2022 for Frustrated Murder against
Kinedy “Imao” Macaayong Manonggiring Riga.
2. After a sober and soul-searching assessment, analysis, and contemplation of the
facts surrounding the circumstances of my injuries, I realized that there was a
misapprehension of facts in the said case.
3. I and witness, Habil B. Nathangcop, cannot identify with certainty as to whether it
was accused Widad “Wesky” Mamaingco Unda who committed the killing against
my son.
4. With the intervention of prominent Datus of Taraka, Lanao del Sur and other civic
leaders, I have decided to desist and withdraw this case since aside from the
aforementioned reason, the civil aspect of this case was amicably settled.
5. In view of the foregoing, I am no longer interested in the further prosecution of
this case. I clear the accused of whatever responsibility or liability to me.
6. I hereby inform the Office of the Provincial Prosecutor of Lanao del Sur that I am
withdrawing my complaint against Kinedy “Imao” Macaayong Manonggiring Riga.
7. I execute this affidavit on my own free will and volition, free from coercion,
intimidation, or any other duress and pray that this case be dismissed.
