Joint Affidavit of Desistance

AFFIDAVIT OF DESISTANCE

I, _____________________________, of legal age, Filipino, married and a resident of


Lim Ext., Digos City, Davao del Sur, after having been duly sworn in accordance with law,
hereby depose and say:

That I am the complainant in the case for ROBBERY BY THE USE OF FORCE UPON
THINGS against _____________________________ in the case entitled “People of the
Philippines, vs. ______________________ as per Criminal Case No. () pending before the
Regional Trial Court, Branch 61, Digos City, Davao del Sur;

That after a serious deliberation on the facts and circumstances surrounding the
instant case considering that accused ________________ expressed remorse and promised
not to do the same acts again and for Humanitarian reasons, I am manifesting my
intention and decision to cease and desist from further prosecuting
________________________ only pertaining to said Criminal Case;

In view of the foregoing, I am no longer interested in pursuing this case against him,
and I hereby desist in prosecuting the said complaint and information;

That I hereby execute this Affidavit of Desistance voluntarily so that the above-
mentioned complaint be immediately dismissed and considered finally closed in so far
as ______________________ is concerned and to apprise the proper authorities concerned
for the immediate dismissal case for the reasons stated above;

That I hereby inform the Provincial Prosecutor for Digos City and the Honorable
Regional Trial Court, Branch 61, that I will be withdrawing the complaint against
_________________ only in Criminal case no. () to effect this Affidavit of Desistance.
