AFFIDAVIT OF DESISTANCE
I, SHERLY F. PEPICO, of legal age, Filipino, married and resident
of Purok 6, Barangay Batinguel, Dumaguete City, Negros Oriental,
Philippines after having duly sworn to in accordance with law, hereby
depose and state:

That I am the complaining witness in Criminal Case No. 18680


entitled People of the Philippines vs. Alter G. Pepico for Violation of Sec.
5(e)(2) of R.A. 9262;

That the accused in the said criminal case, Alter G. Pepico, is my


husband and the father of my children;

After carefully and meticulously considering the facts,


circumstances, and events surrounding the filing of the above case in
this Honorable Court was without basis as the filing of the same was
made or arose out of my misapprehension and overreaction to
understand the said facts and circumstances of said incident.

In view of the above, I am desisting from further prosecuting the


above case against my husband, Alter G. Pepico, and will no longer
testify against him, thus I pray for the Honorable Court to dismiss the
case;

That, this affidavit is executed out of my own free will and volition
for the purpose of signifying my volition to refrain from further
prosecuting the aforementioned person;
