RESOLUTION

The respondents Sharmaine Samson y JCO and Kristine Colet A. Marty were charged for
the crime of ETAFA in a complaint filed by Sps.Elbert Bringas and Valyn Bringas on Augus 1,
2018. The antecedent facts are as follows:

That on June 10, 2018, the Complainants remitted five thousand pesos to the accused in
consideration for the latter’s “ukay ukay” investment scheme which promised a return of said
investment with an interest of 50% weekly.

That on June 20 and 29 of 2018, the spouses received two thousand four hundred and
twenty five pesos on each respective date as pay outs on income of investments.

Subsequently the accused managed to persuade the complainants to pay an additional


fifteen thousand pesos to their initial investment in order for them to become a regular investor
which prompted the spouses to remit five thousand pesos on the separate dates of June 24, 20,
2018 and July 9, 4, of 2018.

The complainants eventually aver that the accused’s declaration of bankruptcy is tainted
with ill motives which led the said complainant to press charges for estafa.
