Attempted Homicide Complaint Affidavit

Darwin Calabiao filed an affidavit-complaint charging Orlino Dacuycoy with attempted homicide. According to the affidavit, on November 26, 2014, Calabiao was fetching his daughter from their mother's house when they witnessed an argument between neighbors. Dacuycoy, who appeared intoxicated, fired his gun towards the pavement. When Calabiao's daughter heard the gunshot, she ran back to their mother's house. Dacuycoy then pointed his gun at Calabiao and fired, but missed. Calabiao fled in fear for his life to the police station to report the incident.

AFFIDAVIT-COMPLAINT

I, DARWIN C. CALABIAO, Filipino, of legal age, married and a


resident of Centro East, Santa Teresita, Cagayan, after having been duly
sworn to in accordance with law, do hereby depose and state that:

1. I am formally charging respondent ORLINO DACUYCOY, a


resident of Centro East, Santa Teresita, Cagayan for the crime of
ATTEMPTED HOMICIDE penalized under Article 249 in relation to
Article 6 and 51of the Revised Penal Code of the Philippines, committed
as follows:

a) On November 26, 2014 at around 8:30 o’clock in the


evening, I went to our mother’s house to fetch our twelve
(12) year-old daughter;

b) When I and my daughter are on our way back to our house,


I saw Rining Sadac and his wife having an argument;

c) Suddenly, respondent Orlino Dacuycoy came out of their


house, which is just in front of our house, and shouted
“ANIA PROBLEMA YU, UKINNA YU!”;

d) Then almost immediately, Orlino Dacuycoy, who is


apparently under the influence of liquor, discharged his
firearms towards the cemented pavement;

e) When my daughter heard the gunshot she immediately run


back to the house of our mother where we came from;

f) Thereafter, when Orlino Dacuycoy saw me he pointed his
gun at me and shot me but luckily I was not hit with the
bullet;

g) I ran away because of fear for my life and because I saw that
Orlino Dacuycoy was then intent in shooting me;

h) I proceeded to the Philippine National Police (PNP) Station


at Sta. Teresita, Cagayan to take refuge and to report the
incident.

2. The incident was witnessed by my brother Dennies C.


Calabiao whose affidavit is hereto attached and made integral part of
this complaint as Annex “A”;

3. I am executing this Affidavit-Complaint to attest to the truth


of the foregoing facts and circumstances and to formally charge
respondent ORLINO DACUYCOY, a resident of Centro East, Santa
Teresita, Cagayan for the crime of ATTEMPTED HOMICIDE penalized
under Article 249 in relation to Article 6 and 51of the Revised Penal
Code of the Philippines.

IN WITNESS WHEREOF, I have hereunto affixed my signature this
