Compromise Agreement

The parties agreed to settle the criminal case of attempted estafa through a compromise agreement. The accused, Abegail Galit y Geraban, agreed to pay the private complainant, Sidney Gestur Stephanson, fifty thousand pesos (PHP 50,000) to resolve the civil aspect of the case. The accused must pay PHP 25,000 by November 25, 2012 and PHP 25,000 by December 25, 2012 through deposits into the complainant's bank account. Failure to comply will allow the complainant to seek a writ of execution and revive the criminal case. Upon full payment, the complainant will terminate the case.

married, American Citizen, herein represented by ATTY. ERIC P.
FUENTES1, of legal age, married, Filipino , both with postal address at
BERNARDO AND FUENTES AND ASSOCIATES LAW OFFICES

ACCUSED ABEGAIL GALIT y GERABAN, of legal age, Filipino,


single and with postal address at BLOCK 30 Lot 90 Liwayway Homes
Subd. Anabu 1, Imus Cavite.

Agree as follows:

Both parties agreed to settle the civil aspect of the above-mentioned case
with the accused paying the private complainant the amount of
FIFTY THOUSAND PESOS (Php 50,000.00) inclusive of damages and
attorney’s fees. Herein accused shall pay herein complainant the following
amount on the following dates/schedules, to wit:
I. Php 25,000.00 On or before November 25, 2012
II. 25,000.00 On or before December 25,2012

Payment in cash shall be made by the accused through deposit in the


BANCO DE ORO SAVINGS ACCOUNT (Subic Times Square Commercial
Complex , Subic Bay Freeport Zone) with Account No. 5860314362 under
Account Name Sidney G. Stephanson

Failure on the part of the accused to comply with this shall entitle the
complainant to a Writ of execution which shall become immediately due and
demandable and the revival of the criminal aspect of the case.

In case of full payment, the complainant shall likewise undertake all the
necessary actions to terminate the case upon full compliance of the accused on
the stipulations under paragraph one (1) of this compromise agreement.

IN WITNESS WHEREOF, the parties hereto have mutually and


voluntarily agreed to the above stipulations and signed this Agreement at
Metropolitan Trial Court Branch 27 Manila this 31 st day of August 2012.
