MEMORANDUM OF DEPOSIT OF TITLE DEEDS8

This Memorandum of Deposit of Title Deeds executed at


Chennai on this the 20th day of March 2024 by Mr. S PARTHIBAN
(PAN : AYBPP4082C, Aadhaar No.5316 8704 5867) son of Mr.
Selvakumar, aged about 35 years, Residing at 5/1044A1 H Block
27th Street, Anna Nagar West, Anna Nagar, Chennai - 600040
hereinafter Called the PARTY OF FIRST PART which term shall
include his legal heirs and anyone claiming under him.
TO AND IN FAVOUR OF

HDFC BANK LTD having its Branch at, No: 128, Nm Towers, Nelson
Manickam Road, Aminjikarai, Chennai-600029 (hereinafter Called the
PARTY OF SECOND PART which expression shall unless excluded by
or repugnant to the context be deemed to include its successors and
assigns). Whereas, the Party of the First Part has been sanctioned a
loan of Rs.49,00,000/-(Rupees Forty Nine Lakhs only) at Chennai,
Whereas the PARTY OF FIRST PART has agreed that the repayment of
the said loan of Rs.49,00,000/-(Rupees Forty Nine Lakhs Only)
shall be secured by deposit of the Deeds of immovable property
belonging to him.

Whereas, the party of the first part has agreed to create the security
interest to secure the sanctioned loan to be advanced / agreed to be
advanced by HDFC BANK LTD THE LENDER as the secured creditor
in accordance with the provisions of Secion-58(f) of Transfer of
Property Act, 1882.

Whereas, the party of the first part had met Mr.THAMARI at No: 128,
NM TOWERS, Nelson Manickam Road, Aminjikarai, Chennai-600029
on 29/12/2023 and has deposited the documents as described in
Schedule A for creation of the security interest.

Whereas, the party of the first part is authorized to deposit the said
Title Documents with intent to create a mortgage by way of deposit of
title deeds pertaining to the said immovable property/ies.

Now this agreement relating to Deposit of title deeds witnesseth.


That in consideration of the sum of Rs.49,00,000/-(Rupees Forty
Nine Lakhs Only) sanctioned by HDFC BANK LTD to Mr. S
PARTHIBAN as security for due payment of the said sum of
Rs.49,00,000/-(Rupees Forty Nine Lakhs Only) together with
interest that may become due and payable, the Party of the First Part
has this day deposited with the HDFC BANK LTD., the Title Deeds
more fully described in Schedule ‘A’ relating to his property more fully
described in Schedule ‘B’ hereunder with intent to create an equitable
mortgage by way of Deposit of Title Deeds of the said property owned
by the party of the first part, including interest, commitment charges,
cost charges and other monies that may become due and payable
from time to time by him to HDFC BANK LTD.

RCC terraced building with all its amenities, Electricity Service
Connection, Well, comprised in old S.No.47/9, Patta No.3300 as per
Patta S.No.47/9B, approved by CMDA PPD.LO.No.6/2000 in the
Layout named “PRASANTH COLONY” situated at Sembakkam Village,
Tambaram Taluk, Chengalpattu District and bounded on the:

North by : Vacant Plot


South by : Plot No.5
East by : Vacant Plot
West by : 24 Feet Road

Measuring

East to West on the Northern side : 50 Feet 9 inches


East to West on the Southern side : 54 Feet
North to South on the Eastern side : 30 Feet
