MEMORANDUM OF DEPOSIT OF TITLE DEEDS

This memorandum of Deposit of Title Deeds is executed at Redhils on this


14th day of August 2024 by

Mrs. R. PONNIYAMMAL, (Aadhaar No.7405 4079 6025)


W/o.Mr.Rajendiran, aged about 59 Years, residing at No.56, South Street, VGK
Puram, Kanagammachatram, Panapakkam, Tiruvallur, Nedambaram, Tamilnadu -
631204. (Hereinafter called the MORTGAGOR. (Whereas the term Mortgagors,
unless repugnant to the context shall mean and include her representative’s heirs,
successors, executors, administrators, trustees, Legal representatives and assigns)

SFC5546) Here in referred to as the MORTGAGEE. (Whereas, The term
Mortgagor and Mortgagee, unless repugnant to the context shall mean and include
their representatives heirs, successors, executors, administrators, trustees, legal
representatives and assigns)
Whereas, the Mortgagor is the absolute owner of all that Piece and Parcel of the
property being of Residential Land and Proposed Building, bearing in the Patta
No.64, Compraised in Gramanatham Old S.No.202, New S.No.284/12 with an extent of
1113 S.ft, out of 545 Sqmt, Situated at Door No.588, Venugopalapuram Village, No.41,
Panapakkam Group, Tirutani Taluk, TIruvallur District, and described in the Schedule
here under written and here in after referred to as the SCHEDULE PROPERTY.

Whereas the Mortgagor is the absolute owner of the Schedule Property who has
acquired the same though Sale deed vide Document No.4912 of 2015, S.R.O.
Tirutani, Book No.1 since then Mortgagor is in peaceful Possession and
enjoyment of the schedule property and paying taxes and levies thereon, as
absolute owner thereof and holding the Title doc’s and documents pertaining to
the SCHEDULE “A” PROPERTY, which are briefly described in the
SCHEDULE hereunder and herein after referred to as the
SCHEDULE‘B’PROPERTY.

Whereas Mortgagors being in need of money for the purpose of personal and
family necessities, the Mortgagor requested the Mortgagee to lend him a total
sum of Rs.9,88,000/- (Rupees Nine Lakhs Eighty Eignt Thousand Only) here in
after referred to as the“loan amount”, which the Mortgagee has agreed to do on
the Mortgagor executing this equitable mortgage by deposit of title deeds with a
view to secure there payment thereof with interest as here in after provided.

And therefore the total loan amount of Rs.9,88,000/- (Rupees Nine Lakhs Eighty Eignt
Thousand Only) lent and advanced by the Mortgagee to the Mortgagor on the
execution of these presents and the receipt whereof the Mortgagor here by
admits.

Without prejudice to the right of the Mortgagee to take any action on default as
herein under provided, and it is agreed and declared that in the event of
Mortgagor committing default in payment of any installment of interest or
committing breach of any other term of this deed, the whole amount of principal
then due with interest thereon will at the option of the Mortgagee become pay
able forth with as if the said date had expired.

And this deed further witnessed that in consideration a fore said, the Mortgagor
here by created Equitable mortgage by way of Deposit of Title Deeds pertaining
to the SCHEDULE ‘A’ PROPERTY described hereunder written as a security for
repayment of the loan amount with interest and all other moneys due and payable
hereunder with a condition that on the Mortgagor repaying the said LOAN
AMOUNT with all interest and other

Moneys due to the Mortgagee (here in after referred to as the Mortgage amount)
the Mortgagee will release the SCHEDULE B title deeds pertaining to the
SCHEDULE A PROPERTY from equitable mortgage and shall if so required by
the Mortgagor execute a deed of release but at the costs of the Mortgagor after
receiving the pre closure penalty as per loan agreement on the outstanding
principle amount.
And it is further agreed and declared by the Mortgagor that in the event of the
Mortgagor failing to pay the said principal sum with all interest and other moneys
when the same shall become due and payable under these presents.
And it is further agreed and declared by the Mortgagor that, he/she shall also be
liable to pay all the costs, charges and expenses that the Mortgagee within cur for
the protection of the mortgage security and or for the realization of the LOAN
AMOUNT and the same shall be deemed to form part of LOANAMOUNT and
the security therefore as aforesaid and also agree to pay all the necessary charges
costs fines and fees which would fall due in the event of change in the rules of
RBI or change in the company’s policy.
And it is further agreed that in the event of the said SCHEDULE
PROPERTY being destroyed or damaged by fire or any accident as above
said. The Mortgagee will be entitled to receive the insurance claim under

such policy to the exclusion of the Mortgagor and to appropriate the same
first towards all arrears of interest and then the principal amount or as any
part there of as maybe sufficient to pay the mortgage amount due and if any
surplus remain she same only will become pay able to Mortgagor.

The Mortgagor herein admit and agree all the contents of the Home equity
agreement which he/she has signed along with this Memorandum of Deposit of
Title Deed to be part and parcel of this deed.

All that Piece and Parcel of the property being of Residential Land and
Proposed Building, bearing in the Patta No.64, Comprised in Gramanatham Old S.No.202,
New S.No.284/12 with an extent of 1113 S.ft, out of 545 Sqmt, Situated at Door No.588,
Venugopalapuram Village, No.41, Panapakkam Group, Tirutani Taluk, TIruvallur District,
Registration District of Kancheepuram and Registration Sub District of Tirutani and bounded
on the
North by : Gunasekar’s Remaining Plot
South by : Street
East by : Lane,
West by : Devagi’s Vacant Plot,
In between
East to west on the Northern side : 26 ½ Feet
East to West on the Southern side : 26 ½ Feet
North to south on the Eastern side : 42 Feet
North to South on the Western side : 42 Feet

Total admeasuring 545 Sq.Meter or 1113 Sq.ft., Land with Building.
