AFFIDAVIT OF CA VEATOR IN SUPPORT OF CAVEAT

OPPOSING GRANT OF PROBATE

We, Renu Ajay Narula, Mahima Amit Chhangani and Aditi

Pranay Kapoor, aged adults, Indian Inhabitants, residing at the

address as mentioned aforesaid, the Caveators abovenamed do

hereby state and declare on solemn affirmation as under:

1. We say that Caveator no. l is the Daughter in law of late Mr.

Pannalal Harnamdas Narula(hereinafter referred to as the

"deceased") and Caveator nos. 2 and 3 are the daughters of

Caveator no. J herein and grand daughters of the said

Deceased.

2. We say that we have received the copy of the Testamentary

Petition through the Advocate of the Petitioner vide Notice

dated 1 8 . 1 1. 2 0 2 4 . We say that we have Caveatable interest to

file Caveat in the above Petition. We say that the Advocate for

the Petitioner vide the said Notice has requested the Caveators

to duly provide the notarized copy of the Consent Affidavit on

urgent basis.

3. We say that vide Notice dated 1 8 . 1 1. 2 0 2 4 issued by the

Advocate for the Petitioner in the captioned matter, it was

learnt that the Petitioner has filed the present Testamentary

Petition for Probate on the basis of the alleged photocopy o f ·

the Last Will dated 2 6 . 0 2 . 2 0 1 5 of the said deceased. Hereto

annexed and marked as Exhibit "A" is the copy of the Notice

dated 1 8 . 1 1. 2 0 2 4 issued by the Advocate of the Petitioner to

the Caveators herein

4. We deny the execution of the alleged Will dated 2 6 . 0 2 . 2 0 1 5 as

the same is surrounding by various suspicious circumstances.

We are therefore challenging the execution and validity of

the said alleged Will dated 2 6 . 0 2 . 2 0 1 5 executed by the said

deceased and the captioned Petition filed by the Petitioner

herein, on the following grounds:

a. We say that the Dispositions made in the said alleged

Will is executed in a suspicious circumstances which

must be satisfactorily explained before the Petitioner can

get the Probate with the said alleged Will to the

properties and credits left by the deceased.

b. We say that the alleged will is drafted in a vague manner

since the alleged Will does not completely describe the

addresses of the immovable properties. We further say

that the alleged Will is not a registered Will but rather

the same is notarized document, which raises further

suspicion regarding the execution of the alleged Will.

c. We further say that the alleged Will was not executed by

the said deceased voluntarily but the same was executed

under the undue influence and pressure exerted by the

Petitioner. We say that the alleged Will had been got

signed from the deceased without his knowledge of its

contents and application of mind by him.

d. We say that at the time of execution of the alleged

Will, due to old age, the said deceased was not in a

disposing state of mind to execute the alleged Will,

using his own judgment and discretion and to make

bequest therein in his full conscious state being aware of

all his acts and consequences, therefore the said

deceased has not executed the alleged Will and bequest

contained therein voluntarily and of his own free will,

accord and desire as the said deceased was not in good

mental state and health and was under misguidance,

pressure and influence while executing the alleged Will.

e. We further say that the Advocate for the Petitioner vide

Para 2 of the Notice dated 1 8 . 1 1. 2 0 2 4 issued by the

Advocate for the Petitioner, it was stated that all the

legal heirs are with the possession of the photocopies of

the Original notarized Will, however the same are not

provided by the said Deceased. We state that the

Petitioner is trying to create a false concocted story so

as to mislead this Hon'ble court. We therefore say that

the aforesaid Petition deserves to be dismissed.

f. Without prejudice to the aforesaid contentions, we say

that the Petitioner vide Para 3 of the captioned petition

has stated that "The notarized original of the said

writing, hereinafter referred to as the "WILL" is

lost/misplaced/not traceable at present despite due

diligence". However, the Petitioner neither contended

as to what due diligence was undertaken by the

Petitioner nor contended as to how and when the

Original Will was lost or could not be found.

g. We say that the Petitioner vide Para 3 has stated that the

Petitioner has filed a Police complaint in Mulund Police

Station on 0 3 . 0 7 . 2 0 2 4 (before 4 months of filing the

present petition) thereby recording the loss of the

Original notarized will. We state that the Petitioner has

wrongly filed the Police complaint so as to create a false

concocted story to obtain Probate from this Hon'ble

court.

h. We further say that the Petitioner vide Para 5 has alleged

that Late Mrs. Kailash Pannalal Narula was the complete

owner of the Flat no.A-61 (more particularly described

in Schedule-I at Sr.no.]) and thereafter her dying

intestate, the Deceased is only entitled to 25% share in

the said Flat no. A-61. We say that the Petitioner has

not provided and/or annexed any documentary proof so

as to establish that Mrs. Kailash Pannalal Narula is the

rightful and legal owner of Plat no. A - 6 1 .

1. We say that the Petitioner vide Para 5 has also alleged

that the Deceased only owns 18.20% shares in Mis.

Fabina Textiles Pvt. Ltd, whereas in the alleged Will it

is stated that the said deceased owns 33% share in the

said public company. We state that the Petitioner has

neither provided and/or annexed any documentary proof

whatsoever so as to validate such statement.

j. We say that the Petitioner vide Para 7 has also alleged

that the value of all the assets after deducting the items

mentioned in Schedule-II is to the tune of Rs.

1,25,22,781/- (Rupees One Crore Twenty Five Lakhs

Twenty Two Thousand Seven Hundred and Eighty One

Only), however the Petitioner has neither annexed any

valuation report nor stated as to how the Petitioner has

obtained such valuation of the properties as mentioned

in the alleged Will.

4. In the aforesaid circumstances, We object to the grant of

Probate with alleged photocopy of the Will annexed in the

captioned Petition filed by the Petitioner abovenamed. We

therefore say that the captioned petition deserve to be dismissed

and thus this Hon ' ble Court may be pleased to dismiss the above

Petition with cost.
