PLAN OF ACTION – Trademark Infringement

1. Root Cause of the Issue
After reviewing the notification and conducting a thorough internal audit, I have identified
that the issue stemmed from listing one or more branded items without having the proper
authorization or documentation to sell them. The item(s) in question were mistakenly listed
without full understanding of the trademark restrictions or brand ownership policies enforced
by Walmart Marketplace.
2. Immediate Actions Taken
I immediately removed all listings related to the reported trademarked products from
my Walmart account.
I reviewed my entire product catalog to ensure that no other listings infringe upon any
registered trademarks.
I reached out to the brand rights owner (if applicable) to clarify the issue and confirm
the infringement.
I have archived all correspondence related to this case and retained a copy for future
compliance reference.
3. Preventive Measures Implemented
I have implemented a stricter internal vetting process to verify the authenticity, brand
ownership, and listing rights for every product before listing.
I now cross-reference product names and brand terms against the USPTO trademark
database to avoid future violations.
I have trained myself and my team on Walmart’s Intellectual Property (IP) and
Brand Infringement Policies.
I have assigned a dedicated compliance contact to ensure all new listings go through
approval checks.
I will avoid listing any branded/trademarked products unless I have clear authorization
or proof of resale rights.
4. Request for Reinstatement
I understand the seriousness of violating Walmart’s Intellectual Property policies and assure
you that this will not happen again. I respectfully request that my account be reinstated so I
can continue providing value to Walmart customers while fully complying with all
marketplace rules and brand protections.
Thank you for the opportunity to resolve this matter.
