We have checked the notification dated “29th July 2024” regarding Brand Infringement Rights that has
been revoked due to one of our listings. In response to that we have prepared a detailed plan of action
to prevent such complaints in the future. As required we are providing below the root causes leading to
complaints and the corresponding preventive & corrective action plan to counter the same.
Root-Cause Analysis –
I received a notification in my Seller Central account indicating that my selling privileges have been
temporarily suspended due to brand infringement.
As a new Amazon seller, we were unaware that the design used in one of our listings was similar to a
design registered by Apple. This was an unintentional mistake, and we apologize for the oversight.
Moving forward, we are committed to adhering to Amazon’s guidelines to ensure that we do not violate
any policies.

III. In order to proactively avoid future incidents, I will ensure that my team is well-versed
in Amazon policies. Additionally, I will designate a dedicated staff to regularly check our
inventory for trademarks and other relevant factors to prevent any inadvertent or
incorrect infringement claims.
We have considered some steps to avoid such issues in future:-
Gather Information – We identify all the specific instances of brand infringement and will
accordingly collect evidence such as screenshots, product details, and any other relevant
information and will also provide the supporting documents regarding the authenticity of our
product.
Contact the Infringing Party – We reach out to the party who is responsible for mapping the
listings and will clearly communicate the issue and request that they cease the unauthorized
use of our brand.
If needed we also provide the supporting evidences.
Communicate with the Platform – We reach out to the platform's support or legal team to
initiate a discussion regarding the infringement. Furnish them with the essential evidence and
information related to the infringement issue. During our communication, we inquire about the
specific procedures the platform follows in handling cases of brand infringement, seeking clarity
on their approach and the steps involved in resolving such matters.
Monitor and Document Progress - Maintained a record of all correspondence with both the
infringing party and the platform. Document any steps or measures implemented by either the
infringing party or the platform in response to the identified issue.
Modify or Clarify Product Listings – We ensure that our own product listings are accurate and
well-differentiated to avoid confusion.

As an Amazon seller, we have listed various products on our account, including earbuds,
watches, and other electronics. After receiving an infringement notice for trademark misuse
on our account, we took immediate and comprehensive actions to comply with Amazon's
policies and rectify the situation.
