1. Laurence Joel M. Taliping is filing an affidavit of desistance as the private complainant in the criminal case of People of the Philippines vs. Angelo Villanueva Y Babelonia for reckless imprudence resulting in damage to property. 2. After carefully re-evaluating the facts of the case, Taliping has concluded the filing was due to a misunderstanding and the incident was accidental. 3. AFFIDAVIT OF DESISTANCE

I, LAURENCE JOEL M. TALIPING, of legal age, Filipino


and with postal address at house No. 1996, S.D.A Road,
Digos city, Davao del Sur, after having been duly sworn to in
accordance with law, depose and state that:

1. I am the private complainant in the case entitled


People of the Philippines vs. Angelo Villanueva Y Babelonia,
Criminal Case No. 12-200 presently pending before the
Regional Trial Court of Digos.

2. After a careful study and re-evaluation of the facts


which led to the filing of this case, I came to the conclusion
that the filing of the same against the accused was a result
of a misunderstanding and misapprehension of facts as the
incident involved is purely accidental in character.

3. Consequently, I am no longer interested in


pursuing and prosecuting the above-entitled case. Hence, I
am desisting from further prosecution of the criminal
complaint for Reckless Imprudence Resulting In Damage to
Property against the accused, Angelo Villanueva Y Babelonia
and I am moving for the dismissal of the instant criminal
case.

4. Considering the aforementioned, I hereby release,


remit, renounce, and discharge NEW ZIRCON, INC. from any
and all liabilities, claims, demands, actions and causes of
action of whatever nature and kind which may have arisen
by reason of, or in connection with the above-mentioned
cases.

5. I am executing this affidavit to attest to the truth


and veracity of all the foregoing facts.
