1. Rosemarie Esmana filed a complaint for estafa against Eleonor Maravilla-Ona that was pending before the Regional Trial Court Branch 90 in Dasmariñas City, Cavite. 2. After confronting the respondent, Rosemarie Esmana learned the complaint was due to a misunderstanding that has now been resolved between the two parties. 3. Rosemarie Esmana executed an affidavit of desistance to request the court dismiss the case against Eleonor Maravilla-Ona, as she is no longer interested in further prosecution.

AFFIDAVIT OF DESISTANCE

I, ROSEMARIE ESMANA., Filipino, of legal age and residing at Blk 40, Lot 28b,
Revelation St., Citihomes Subd., Brgy. Langkaan 2, City of Dasmarias, Cavite,
after having been duly sworn to in accordance with law, do hereby depose and
state: That
-
1. I am the private complainant for ESTAFA under Art. 315 Par. Za) of RPC now
pending before the Regional Trial Court Branch 90, City of Dasmarias, Cavite
under Criminal Case No. 12684-13;

2. After confront with the respondent, it was learned that the above complaint
was lodged due to some miscommunications and misunderstanding on the
circumstances surrounding the incident and that said misunderstanding has
already been patched up between the private complainant and the respondent
herein and for this reason , iam no longer interested in the further prosecution of
the above-mentioned case;

3. I executed this Affidavit of desistance to attest to the truthfulness of the


foregoing statement and to request the HONORABLE COURT REGIONAL TRIAL
COURT BRANCH 90, CITY OF DASMARIAS CAVITE to dismiss the
aforementioned case against ELEONOR A. MARAVILLA-ONA and for whatever
legal purpose the same may serve;
