The "Fair Use for Sponsors" Agreement
✅ You can:
- Build Commercial Apps: Use the libraries and plugins to build apps/services that you sell.
- Modify the Code: Change the code to fit your specific project needs.
- Keep What You Paid For: If you cancel your sponsorship, you can keep using the version you already downloaded forever.
- Scale Your Team: Use the $4 tier until your organization hits 101 employees.
❌ You Cannot:
- Leaked Source: Share the source code with anyone who isn't an active iNKraft sponsor.
- Sell "Thin Wrappers": You cannot just rename our work and sell it as your own library or tool. Your product must add significant new value.
- Hoard Improvements: If you fix a bug or add a feature to the original code, you must submit a Pull Request back to iNKraft.
- As-Is: The Software is provided "as-is". iNKraft / Jeff Retz isn't liable for any damages if something breaks.
- Updates: You only get access to new versions and fixes while your sponsorship is active.
Subject to the terms of this License and an active GitHub Sponsorship, the Licensor (Jeff Retz / iNKraft) grants you a non-exclusive, world-wide, non-transferable license to use, modify, and integrate the the Software and associated files (the "Software") into your own projects and commercial applications.
The Software includes, but it not limited to:
- Source code in any programming language (e.g. Kotlin, Rust, Java, Swift, etc.)
- Build-tooling components (e.g. Gradle plugins, compiler plugins, KSP processors, etc.)
- Documentation and configuration files
- Solo & Small Team Tier ($4): Valid for individual developers and organizations with 1 to 100 employees.
- Organization Tier ($9): Required for entities with more than 100 employees.
- Audit Right: iNKraft reserves the right to verify sponsorship tier eligibility based on public employee data.
You are strictly prohibited from redistributing the Software, or any derivative work thereof, in a manner that competes with the original Software. This includes but is not limited to:
- Thin Wrappers: You may not redistribute or sell a product where the primary value is a reproduction of the Software's API, methods, or functionality under a different name, namespace, or foreign-function interface (FFI).
- Functional Equivalency: Any derivative product you sell or distribute must provide Substantial Value-Add. "Substantial Value-Add" is defined as additional functionality that is distinct from, and not merely incidental to, the core functionality of the iNKraft Software.
- No Standalone Resale: You may not sell the repository components as standalone development tools, libraries, or packages.
As a condition of this license, any modifications, bug fixes, or enhancements made to the Software's source code must be submitted to the Licensor via a Pull Request (PR) in the original repository.
- While the Licensor is not obligated to merge these PRs, the act of submission is required for the continued legal right to use the modified version of the code.
- You grant iNKraft a non-exclusive, irrevocable, prepetual license to incorporate these contributions into the Software.
- Cessation of Updates: Upon termination of sponsorship, your right to access the repository and receive new updates or security patches ceases.
- Version Snapshots: You retain a prepetual, non-transferable right to continue using the specific version of the Software obtained during your last active billing cycle for existing and future products, provided the terms of Section 3 (Prohibited Exploitation) are continuously met.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
