The Petition of Lisa Kombe shows that:

1. The Petitioner was on 11st November, 2011 lawfully married to the


Respondent at the Lusaka civic centre in the Lusaka Province of the Republic
of Zambia.

2. After the said marriage the Petitioner, Lisa Kombe and Respondent Stephen
Tingadane lived together as husband and wife at Plot 3004, Muchenja street,
Chelstone, Lusaka.

3. The Petitioner currently resides at House Number 47, Marigold street in


Salama park, Lusaka, the Respondent resides at Plot 3004, Muchenja street,
Chelstone, Lusaka and also in Congo Dr at an address not known to the
Petitioner.

4. The Petitioner is a Businesswoman and the Respondent is a Businessman.

5. There are Three children of the family and these are namely:

▪ Temwani Misha Munthali (Female) born on the 12th day of June, 2010

▪ Mushibwe Michelle Munthali (Female) born on the 22nd day of March, 2012

▪ Zane Jameson Munthali (Male) born on the 15th day of October, 2018.

6. All the three children are biological children of the petitioner and
respondent.

7. There are no proceedings in Zambia or elsewhere in relation to the said


marriage which can affect its validity or substance.

8. There are no proceedings in Zambia or elsewhere in relation to the property


of the said marriage.

9. The Petitioner believes that the marriage has broken down irretrievably.

10. That the Petitioner believes that the marriage has broken down irretrievably
as the parties to the marriage have lived apart for a continuous period of at
least two years immediately preceding the presentation of this petition and the
respondent consents to a decree being granted

11. Details of Living apart

11.1 the petitioner and respondent have not lived together for over 2 years now.

11.3 The Respondent has moved to Congo but even when he is around in
Zambia, he lives at the family house off Manchichi Road, the address above
indicated.

11.4 the parties have not just lived apart for that long but have consequently
grown apart and out of love.

11.5 the parties have resorted to going the divorce route and both are
consenting to the degree being granted.

12. Petitioner therefore prays:

12.1 That the Petition for dissolution of the marriage be granted;

12.2 That there be no order for property settlement as the parties already
shared the property and are both content and comfortable with the
arrangement.

12.4 That there be no order for ancillary relief;

12.5 That the Petitioner maintains custody of his biological children; and

12.6 That costs be borne by the parties.

NOTICE OF PROCEEDINGS
______________________________________________________________________________

TAKE NOTICE that a petition has been presented to this court for the
dissolution of your marriage to the petitioner. A sealed copy of it and a copy of
the Petitioner’s proposals regarding the children are delivered with this notice.

1. You must complete and detach the acknowledgement of service and send it
so as to reach the Court within 8 days after you receive this notice, inclusive of
the day of receipt. Delay in returning the form may add to the costs.

2. If you wish to do so, you may send to the Court a statement setting out your
views on the proposals regarding the children. If you send a statement it will be
placed before the judge dealing with the arrangements for the children and a
copy of your statement will be sent to the Petitioner.

3. If the reply to questions 4 or 6 in the acknowledgement is yes, you must


within 29 days after you receive this notice, inclusive of the day of receipt, file

in the Court an answer to the petition together with a copy for every other party
to the proceedings.

4. If the reply to question 5 in the acknowledgement is Yes, the consequences


to you are that:

a. Provided the Petitioner establishes the fact that the parties to the
marriage have lived apart for two years immediately preceding the
presentation of the petition and that you consent, a Decree will be
granted unless, in the case of a petition for divorce, the Court is satisfied
that the marriage has not broken down irretrievably;
b. Your right to inherit from the petitioner, if he died without having made a
Will, ceases on the grant of a Decree judicial separation or on a Decree
Nisi of divorce being made absolute;
c. Apart from the circumstances listed above there may be other applicable
to you depending on your particular circumstances. About these you
should obtain legal advice from a solicitor.

5. If after consenting you wish to withdraw your consent, you must


immediately inform the Court and give notice to the petitioner.

6. The only fact upon which the petitioner relies in support of the petition is
that the parties to the marriage have lived apart for at least 5 years. Section 6
of the Divorce Reform Act, 1969 provides that if in such a case the respondent
applies to the Court for it to consider the respondent’s financial position after
the divorce, the decree nisi cannot be made absolute unless the Court is
satisfied that the petitioner should not be required to make any financial
provision for you. It is important that you should consider this information
carefully before answering question 7 in the acknowledgement.

7. If the reply to question 7 in the acknowledgement is YES, you must, before


the decree is made absolute, make application to the Court by filing and
serving on the petitioner a notice in Form 8A, which may be obtained from the
Court.

8. If you intend to instruct a solicitor to act for you, you should at once give
him all the documents which have been served on you, so that he may send
the acknowledgement to the court on your behalf. If you do not intend to
instruct a solicitor, you should nevertheless give an address for service in the
acknowledgement so that any documents affecting your interests which are
sent to you will in fact reach you. Change of address should be notified to the
Court.

FAMILY

This is the current and proposed arrangements for the children of the family
are as follows:

1. Temwani Misha Munthali (Female) born on the 12th day of June, 2010

a.) Residence:

The Child is currently staying with the petitioner and it is proposed and agreed
between the parties that she continues to live with the Petitioner the child’s
mother.

b.) Education:

The child attends school at Sonshine School. She is currently in grade Nine (9).
It is proposed that after the decree is granted, she should continue attending
school at the same school.

c.) Access:

The Child currently lives with the Petitioner and it is agreed that the
Respondent will be visiting every after 3 months as he is rarely in the country.

d.) Financial Support:

The Respondent provides the child’s financial needs. The Childs school fees are
at K8,700 and It is proposed and agreed that after the Decree is granted, the
Respondent continues to provide for this child.

The said child is not suffering from any disability or chronic illness or from the
effect of such illness.

The said child is not under the care of a Social Welfare Officer or any
organization.

2. The child Mushibwe Michelle Munthali (Female) born on the 22nd day of
March, 2012

a.) Residence:

The Child is currently staying with the petitioner and it is proposed and agreed
between the parties that she continues to live with the Petitioner the child’s
mother.

b.) Education:

The child attends school at Handmaids sister’s School. she is currently in


grade Eight (8). It is proposed that after the decree is granted, she should
continue attending school at the same school.

c.) Access:

The Child currently lives with the Petitioner and it is agreed that the
Respondent will be visiting every after 3 months as she is rarely in the country.

d.) Financial Support:

The Respondent provides the child’s financial needs. The Child’s school fees are
at K10,700 and It is proposed and agreed that after the Decree is granted, the
Respondent continues to provide for this child.
