California's New Law Legalized Gun Confiscation — No Crime Required!

Moving out of Commiefornia in 2018 was the smartest thing I could have done.

Two years prior, I was served with a restraining order by a vindictive ex-girlfriend which included the order to turn over my firearms to either the police to a gun dealer.

I had to get an attorney and fight the order. I had plenty of evidence to prove that I had not contacted the ex and shown that I have actually avoided her. I was able to get my firearms back eventually. This was my introduction to a so-called "red flag law".

Now, the Commies in Commiefornia led by Gov. Gavin Newscum have a new gun confiscation law that is even worse for gun owners.

Gun News produced the following video discussing this new law.

Its summary:

California has taken its war on gun rights to a new level. Governor Gavin Newsom just signed Assembly Bill 1344, giving District Attorneys the power to confiscate firearms under expanded red-flag laws—even when no crime has been committed. In this video, I break down what AB 1344 really does, how it creates a dangerous precedent for due process, and why this so-called “pilot program” could spread nationwide.

We’ll expose the UC Davis Firearm Violence Research Center’s role, the counties involved, and how prosecutors can now strip citizens of their rights before trial. This isn’t about safety—it’s about control. Watch closely, because what starts in California rarely stays there.

Update On Canada's Big Ugly Gun Grab

Canada's dumb scheme to confiscate guns from its citizens is not faring too well. Five provinces are opposing it.

The NRA-ILA took a look at the program it finds that it is riddled with problems. Naturally, Canada's gun owners are resisting.

They begin with:

Canada’s Liberal government is pressing on with its harebrained gun ban and confiscation program for “assault style weapons,” but, true to form and precedents, it has been far from smooth sailing.

Canada’s National Post newspaper describes the government’s program as “not only severely behind schedule and over-budget, but a newly released internal report shows that Ottawa is doubtful of the plan ever actually working as announced.”

American Rifleman: "We Are Peanut"

The January 2025 issue of American Rifleman arrived in the mailbox yesterday.

The issue has many good articles, but one caught my attention: "An Unlikely Hero". It is the story of the gray squirrel and racoon named Peanut (or P'Nut) and Fred. It is definitely a must-read.

A Texas whistleblower named Monica Keasler  contacted New York's State Department of Environmental Conservation (DEC) and their thugs acted like stormtroopers when they confiscated the innocent animals. She reportedly bragged about it.

The article compares their tragic ends at the hands of bureaucrats when they were confiscated and killed  (to allegedly test them for rabies) and gun owners. The article asks, "How often we seen harmless violations of bureaucratic requirements [...] escalated to the point where livelihoods, freedoms or even lives were unnecessarily lost?"

The outrage by people to this incident possibly added to Donald Trump's victory margin, it is said.

When it comes to tyranny by government bureaucrats, "We are Peanut."

Kamala Harris Has Already Shown Who She Is

It is very hard for a candidate for any office to hide their past, particularly their statements and policy positions with videos and documents surfacing.

Such is the case of Kamala Harris. She is trying to run away from her anti-Second Amendment past and the NRA-ILA has posted an article on her "big problem" as she has already shown who she is.

The article begins with:

At a town hall event on October 21 in Royal Oak, Michigan, Democrat presidential candidate Vice President Kamala Harris was asked how she would make “impactful and immediate progress around gun violence” if she was elected with a Republican majority in Congress.

In her by-now classic “word salad” style, Harris responded that she thinks of the issue “through the lens of many experiences,” then touched upon the “direct trauma for those who have been directly affected by gun violence,” and ended up at “the macropoint” – namely, the “false choice” between thinking that one is either in favor of the Second Amendment or that “you want to take everyone’s guns away.” She offered herself as living proof of this “macropoint” because she’s not only a gun owner “in favor of the Second Amendment,” but believes in “assault weapons bans, red flag laws, universal background checks” and other “common sense gun safety laws.”

It was made obvious at the start of the October 21 event that it was tightly scripted. Moderator Maria Shriver told an audience member that only questions that had been “predetermined” would be permitted, with no spontaneous questions from the floor. Even within this forced and stilted setup, Harris fell flat. It took her until the last few seconds of the over five-minute exchange to actually deal with the question. “We need common sense gun safety laws and I will continue, I’ve done it throughout my career, work with all of our colleagues across the aisle and I know that we can make progress,” she said, “but I’m not trying to take anyone’s guns away from them.”

The explanation for Harris’ emphatic new identity as a gun enthusiast and supporter of constitutional freedoms is that she is struggling to put her past under wraps, a past in which she wholeheartedly embraced extreme gun bans and confiscation, and which has now come back to haunt her.

What Happens When The TSA Intercepts Firearms At US Airports

Above, the TSA checkpoint at the Albuquerque Sunport. Photo by Armand Vaquer.

Bringing a firearm through airport security (TSA) can be a major problem if one does not follow proper procedures. I've never had the need to bring a gun while traveling by air.

It is legal to bring a firearm in one's luggage as long as it is locked unloaded in a hard-sided case and declared with the baggage officer.

But not following the procedures can get one heavily fined, arrested and the gun confiscated.

Here's the official TSA procedures for transporting firearms and ammunition.

MSN posted an article on what happens.

They start with:

As US travelers take advantage of their Second Amendment rights, the Transportation Security Administration (TSA) frequently discovers firearms at security checkpoints throughout the US. By not declaring their firearms, travelers can potentially face legal issues for not following the proper procedures.

While the TSA does not confiscate or seize firearms if a passenger attempts to bring one through the security checkpoint or packs one in their carry-on luggage, the TSA will contact local law enforcement to take possession of the firearm safely. The passenger may be arrested or issued a citation, depending on local laws.

Harris Is The One Lying About Guns

The flip-flopping Kamala Harris tried to ease people's fears that she would try to dismantle the Second Amendment during her debate with former President Donald Trump. Anyone with half a sense is not impressed.

She lied during the debate about many things and that included her stance on guns.

David Codrea in Firearms News examines her debate lies on guns in a new article in Firearms News.

He begins with:

“And then this business about taking everyone's guns away,” Vice President Kamala Harris prefaced a rebuttal in September’s presidential debate, joining forces with ABC News “moderators” against Donald Trump. “Tim Walz and I are both gun owners. We're not taking anybody's guns away. So, stop with the continuous lying about this stuff.”

Walz being a Fudd, a politician with an A rating from NRA who then turned around and embraced the Democrat citizen disarmament agenda after he no longer needed the votes, is well known (albeit not acknowledged by Party apologists). But per Reuters, Harris’s admission to owning a gun was “a revelation that surprised some voters but carried a deliberate political message.”

The political message is “Trust me,” and evokes nothing so much as the fable of the scorpion and the frog. And as for it being a surprise, it shouldn’t be.  Even Dianne Feinstein “kept a revolver in her purse” (an elitist “privilege” denied to her constituents), and Harris’ carrying on the elitist tradition first gained wider attention when she admitted to reporters at a Moms Demand Action rally in 2019 that she did, too, “for personal safety. I was a career prosecutor.”

Kamala Harris On Gun Confiscation In Her Own Words

Too bad Kamala Harris's nose doesn't grow like Pinocchio's nose whenever a lie is told. It would've been several feet long when she had her debate with former President Donald Trump.

One big whopper of a lie was on her position of gun confiscation.

The NRA-ILA posted an article on what she has said about gun confiscation in the past.

They begin with:

During the September 10 presidential debate, President Donald Trump correctly highlighted Democratic presidential nominee Kamala Harris’s support for gun confiscation. A visibly defensive Harris claimed, “We're not taking anybody's guns away. So stop with the continuous lying about this stuff.”

Harris supports gun confiscation. Harris has repeatedly expressed support for a mandatory gun “buyback” program where Americans would be forced to turn over their firearms to the government for a set price – in other words: gun confiscation.

They then show her position on gun confiscation in her own words.

Harris Gun Ownership: Nobody's Buying It

Comrade Kamala Harris raised eyebrows when she said that she and Gov. Tim Walz are gun owners.

The debate didn't have much about the Second Amendment, but the comment was sparked by her recent flip-flops on "assault weapons mandatory buy-backs".

According to the Buckeye Firearms Association, nobody is buying it.

They wrote:

Near the end of the debate, Davis asked, “You wanted mandatory buybacks for assault weapons. Now your campaign says you don’t,” Davis said before asking Harris why so many of her policy positions had changed, according to The Reload.

Vice President Harris didn’t address the question and was only forced to respond later to a criticism by former President Donald Trump warning voters that if elected, the vice president would have “a plan to confiscate everyone’s gun.” She jumped in with a comment that caught viewers’ attention.

“And then this business about taking everyone’s guns away, Tim Walz and I are both gun owners,” Vice President Harris stated. “We’re not taking anyone’s guns away. So stop with the continuous lying about this stuff.”

The vice president’s remark about being a gun owner drew attention. She practically never mentions being a gun owner in all her calls for more gun control and the only reference before is a glancing mention in a 2019 CNN interview. Not surprisingly, Second Amendment supporters were skeptical of her statement.

“So now Harris owns a gun? Ha, I’d love to know what kind/caliber and how often she trains with it,” competitive shooter, GunsOut TV founder and CNN commentator Shermichael Singleton posted on X.

Harris Walks Back On Calls For AR-15 Confiscation

Above, target-shooting with an AR-15 at the gun range. Photo by Armand Vaquer,

When politicians change their stands on issues to be more appealing to voters, one must take these with a grain of salt.

This is flip-flopping.

They may say they changed on some issues, but what's to stop them from changing their stances again once they get elected? In other words, don't trust them! They may say one thing one day and then change it to another the next.

According to The Reload:

The Democratic candidate for President no longer wants to force millions of Americans to sell their AR-15s and similar firearms to the government.

At least, that’s the line her campaign is taking. Unnamed officials with the Kamala Harris campaign told the New York Times on Monday that the Vice President no longer supports many of the progressive policy stances she took during her first presidential run in 2019, including a mandatory buyback of civilian-owned “assault weapons.” Instead, her campaign said that she merely supports banning the sale of those guns moving forward.

The Harris Campaign confirmed the position change in an email to The Reload.

“Correct, the VP will not push for a mandatory buy back as president,” Lauren Hitt, a Harris spokesperson, told The Reload. “She has expressed support for red flag laws, universal background checks and an assault weapons ban.”

The about-face on gun confiscation and retreat to the more politically palatable, though still controversial, stance of an assault weapon sales ban signals the Harris Campaign will more or less track with President Joe Biden on gun policy. It comes amidst a broader shift by the Harris team to pivot back towards more moderate political stances with an eye toward a general election contest against former President Donald Trump this November. In addition to walking back her call for gun confiscation, the Harris campaign also told the Times that she no longer supports banning fracking, eliminating private health insurance to shift toward a single-payer system, or abolishing immigration enforcement.

NRA-ILA: Kamala Harris An Existential Threat To the Second Amendment

His Fraudulency Joe Biden was bad enough on Second Amendment rights, but his soon-to-be-coronated Kamala Harris hold even more extreme anti-gun rights views. After all, she is from the San Francisco Bar Area political machine.

NRA-ILA posted an article on her existential threat to the Second Amendment and her support for gun confiscation.

The begin it with:

Since President Joe Biden unceremoniously dropped out, or was forced out, of the 2024 presidential race on July 21, Vice President Kamala Harris has been effectively coronated as the Democratic presidential nominee.

Gun owners should understand that Harris poses the gravest threat to their Second Amendment rights. In fact, Harris’s record suggests that she does not believe the Second Amendment protects an individual right to keep and bear arms at all. Moreover, Harris has repeatedly called for government confiscation of some of America’s most popular firearms.

19 Attorneys General Opposing DOJ Gun Confiscation Program

19 attorneys general are opposing the Biden Administration's "red flag" gun confiscation program and are urging the DOJ to scrap it.

I have personal experience with California's "red flag" law brought on through a restraining order by a vindictive ex-girlfriend. It was dismissed during a court hearing as I had proof that there was no basis for the restraining order.

According to the Highland County Press:

COLUMBUS – Ohio Attorney General Dave Yost and 18 other state attorneys general are opposing a new federal program that promotes aggressive enforcement of “red flag” gun-confiscation laws.

Yost and his counterparts argue in a letter to U.S. Attorney General Merrick Garland that the National Extreme Risk Protection Order (ERPO) Resource Center, launched in March by the Department of Justice, undermines the Second Amendment and other fundamental rights in a flawed attempt to reduce gun violence.

“The solution to gun violence is not more bureaucracy, and it is certainly not parting otherwise law-abiding men and women from their right to self-defense,” Yost said.

The state attorneys general raise several concerns with the ERPO Resource Center, most notably how the program advocates for laws that allow government officials to “suspend fundamental rights under the Second Amendment with no genuine due process."

So-called “red flag” laws permit authorities to seek court orders authorizing the confiscation of firearms from people thought to pose a danger. Twenty-one states have enacted such laws; Ohio is not among them.

Another issue is whether the DOJ had authority to create the program in the first place. The Bipartisan Safer Communities Act, cited by the department as the impetus for the ERPO Resource Center, makes no mention of such a program. In fact, the letter says, that funding from the 2022 federal law was supposed to go to states and local governments.

The Dirty "Gun Control" Secret of the Left

Every time a mass shooting takes place by some deranged bastard, the clamor of the far Left to enact new gun control and confiscation laws goes, like the following article from the American Thinker states, "like clockwork."

This is happening again in the aftermath of the Maine shooting. The article looks into the reasons why.

Here's a snippet:

Like clockwork, after a mass murder tragedy in at least one “gun-free” massacre zone, with the abject failure of gun control on full display, the gun-grabber ghouls are only too quick to exploit other people’s pain for their political gain, using a crisis to take guns away from their political enemies.

This is the dirty little open secret of the gun grabber left, with virtually all their policy obsessions centered on taking guns away from their political opposition.  None of their fascist fixations even gets close to addressing the severely increasing crisis of crime and terrorism.

Now, we ask: why is that the case?  Why do they care more about confiscating guns from innocent people than criminals and terrorists who pose a severe threat to public safety by several orders of magnitude?

The answer should be obvious: the harmless people of our society who own most of the guns impede the fascist far left’s attainment of full societal control.

FBI Accused of Keeping Gold Coins, Silver of Private Citizens

The reputation of the Federal Bureau of Investigation (FBI) has been severely tarnished in recent years. The following won't to anything to restore its luster, but quite the opposite, unfortunately.

From CoinWeek:

Civil forfeiture is a controversial tactic of government and law enforcement agencies. Your property can be taken without criminal charges levied against you, and it’s up to the Government to decide when (or if) you get it back.

But two people in the Los Angeles area–people who might be considered typical bullion customers and investors in precious metals–are fighting back against this policy in a court of law, with the help of a lawsuit filed by the non-profit Institute for Justice.

Don Mellein, a 79-year-old retiree, and Jeni Pearsons are accusing the FBI (Federal Bureau of Investigation) of losing or stealing their gold and silver coins after the business where they stored the precious metal was raided on March 22, 2021. Neither were accused of any crime.

U.S. Private Vaults, based in Beverly Hills, California, had been under investigation by the FBI for knowingly renting safe deposit boxes to certain customers who then used the boxes to store illegal drugs. The warrant authorizing the raid focused on the company itself and explicitly excluded the seizure of boxes belonging to private customers. The FBI assured the issuing judge that any property taken from uninvolved customers would be held merely for “safekeeping” until such time that the agency could properly return it to the rightful owners. Drugs were indeed found – along with cash, firearms, gold, silver, jewelry, and other valuables.

All told, around 1,400 customers of U.S Private Vaults had their property seized. These customers (including Mellein and Pearsons) all received the same form letter informing them about the civil forfeiture of their property.

There is much more to this story, including a class-action lawsuit. To read more, go here

RFK Jr.: Gun Confiscation Won't End School Shootings

Above, RFK Jr. campaign photo.

The mantra of the far left of the Democrat Party is hell-bent on gun confiscation. But thanks to the constitution and recent Supreme Court decisions, they have been effectively thwarted. They keep trying, though.

One Democrat recognizes this and a Breitbart article points him out.

They wrote:

Robert F. Kennedy Jr. used a townhall in New Hampshire to explain he is not going to take guns and the approach of trying to do so would not stop school shootings.

National Gun Rights Association’s Will Fite tweeted about the townhall on Saturday after RFK Jr. stressed that he is not going to take away guns.

Moreover, he pointed to the Supreme Court of the United States Bruen (2022) decision and noted it is not possible to “do anything” to secure gun control, even if someone wanted more of it.

Gold: FDR's Other "Day of Infamy"

The following was way before my time, but it should be recognized that it was one of the beginnings of the ruination of the U.S. dollar. It took place 90 years ago yesterday.

On April 5, 1933, President Franklin D. Roosevelt issued an executive order forcing the American people to surrender their gold. This was illegal on the face of it as executive orders cannot be directly applied to citizens. But he did it anyway after congress passed an unconstitutional law, the Gold Reserve Act of 1934, that gave FDR dictatorial power. Like sheep, the American people complied.

The story of the "other day of infamy" of FDR has been posted at Money Metals Exchange.

It begins with:

Ninety years ago, Franklin Roosevelt told Americans they had less than a month to hand over their gold or face up to ten years in prison.

December 7, 1941 will forever be remembered as, in the words of Franklin Delano Roosevelt, "a date that will live in infamy." Another infamous date is April 5, 1933—the day that FDR ordered the seizure of the private gold holdings of the American people.

By attacking innocent citizens, Roosevelt bombed the country's gold standard just as surely as Japan bombed Pearl Harbor.

On this 90th anniversary of the seizure, it behooves us to recall the details of it, for multiple reasons: It ranks as one of the most notorious abuses of power in a decade when there were almost too many to count.

It's an example of bad policy imposed on the guiltless by the government that created the conditions it used to justify it. And the very fact of compliance, however minimal, is a scary testimony to how fragile freedom is in the middle of a crisis.

Suddenly on April 5, 1933, FDR told Americans—in the form of Executive Order 6102—that they had less than a month to hand over their gold coins, bullion and gold certificates or face up to ten years in prison or a fine of $10,000, or both.

How Dictatorships Used Gun Control

If one wonders why Second Amendment supporters are so adamant in protecting our right to keep and bear arms, they should take a look at a new article at AmmoLand on how dictators used gun control throughout history against their citizens.

They start it with:

USA – -(AmmoLand.com)- Mao Zedong once said, “Political power grows out of the barrel of a gun.”

Which is why he made sure no one in China could access that political power. Throughout history and well into the modern world, gun control legislation heralded the death of democracies. Usually, it preceded an attempt by the government to take full control of people’s lives. Weapon bans frequently led to human rights abuses, including massacres and sometimes outright genocide.

According to a 2022 Gallup poll, 66 percent of Americans surveyed support stricter gun laws and a sizeable minority advocate for a total gun ban. Most of these people base their opinions on recent tragic events like mass shootings and high crime rates involving firearms and refuse to believe the government would ever do anything to take away their rights.

It’s almost as if they don’t remember the lockdown. Granted, it was for the sake of public health ….in the beginning. Still, once the United States government began restricting travel and requiring the entire population to take a COVID vaccine designed in just a couple of days, as was the case with Moderna, many Americans began to view this as an abuse of government authority, especially when some who took the “life-saving” vaccine died from COVID anyway.

A government gets away with whatever its people allow. A recent attempt to ban semi-automatic firearms across the state of Illinois was met with widespread resistance. 88 percent of the state’s counties refuse to enforce the governor’s mandate, and they can because of the Second Amendment. Additionally, sheriffs work for their communities, not for the state.

Unfortunately, this has not always been the case. Many historical and current dictatorships had their start when they stripped firearms from their citizens and robbed them of their right to rebel against injustice.

NRA-ILA: NM List of Radical Gun Control Bills

From the NRA-ILA (January 17, 2023:

Dear Second Amendment Supporter:

The New Mexico Legislature convenes TODAY for its 60-day session and progressive, anti-gun lawmakers have already filed a laundry list of extremist gun control proposals that would make Biden and Bloomberg proud.

This week, it is imperative that you contact your State Representatives and urge them to OPPOSE HB 9, HB 50, HB 72, HB 100 & HB 101, and your State Senators and ask them to OPPOSE any new gun control laws. Your NRA-ILA will be fighting these measures at the Roundhouse in Santa Fe, but we also need YOU to fully engage in the critical effort to protect your Second Amendment rights in the Land of Enchantment.  Contact information for State Representatives and State Senators will be updated this week. If you don’t know who your state lawmakers are, visit https://www.nmlegis.gov/Members/Find_My_Legislator.

Be on the lookout for alerts in your inbox on when these bills are set for committee hearings and what action items you can take to help stop these attacks on your rights:

1. House Bill 9 by Rep. Pamela Herndon (D-ABQ) creates criminal liability for gun owners if a minor gains access to firearms; no exceptions for consent or authorized use of the firearm, which would have a chilling effect on youth hunting or 4-H and other competitive shooting programs. New Mexico law allows minors to own, possess and use long guns, and even handguns in some cases, for such activities.

2. House Bill 50 by Rep. Patricia Roybal Caballero (D-ABQ) makes it a felony to transfer or possess any standard capacity magazine capable of holding 10 or more rounds of ammunition. The 9-round limit would be the lowest in the nation and would effectively ban the use of some of the most popular pistols and rifles purchased by New Mexicans.

3. House Bill 72 by Rep. Patricia Roybal Caballero (D-ABQ) makes it a fourth degree felony to possess or transfer a “semiautomatic firearm converter”, which could include binary triggers (which, when attached to firearms, do not make the firearm a machine gun under federal law). The “definitions” section of the measure is longer than the provisions setting out what activity is actually being criminalized under the act, indicating the bill is confusing and will be difficult to implement or enforce.

4. House Bill 100 by Rep. Andrea Romero (D-Santa Fe) expands New Mexico’s so-called “universal background check” law to include a mandatory 14-day waiting period on all firearm purchases. This criminal protection bill would delay your ability to exercise your right to protect yourself from a violent attack.

5. House Bill 101 by Rep. Andrea Romero (D-Santa Fe) bans the manufacture, possession, purchase, sale or transfer of countless commonly-owned semi-automatic rifles, pistols and shotguns dubbed “assault weapons” under the act, and standard capacity magazines capable of holding more than 10 rounds of ammunition; current owners would be required to move them out of state, sell them to a federal firearm licensed dealer or surrender them to a law enforcement agency prior to July 1, 2023 – or face felony charges.

6. Senate bills in the queue for introduction, but which have not yet been assigned bill numbers: a ban on the carrying of firearms within 100 feet of a polling place during an election (Sen. Peter Wirth; D-Santa Fe); and a prohibition on the purchase or possession of an automatic or semi-automatic firearm by, or the sale of such a firearm to, anyone under the age of 21 (Sen. Bill O’Neill; D-ABQ).

NMSSA: Zac Fort On The 2023 Legislative Session

The 2023 New Mexico Legislative Session officially started today, and the Governor wasted no time in going after our rights. In her State of the State Speech, Lujan Grisham spoke of three anti-gun proposals. First, she endorsed a ban on semiautomatic rifles. The bill that has been filed so far would ban possession of the rifles by civilians all together. Second, she wanted to see legislation to make it easier to sue firearms manufacturers in New Mexico. This is in direct contradiction to the Protection of Lawful Commerce in Arms Act (PLCAA) which has been upheld many times in court before. Third, she somewhat quixotically wanted to close the "straw purchase" loophole in state law. Straw purchases, as defined in Federal Law, are already a crime, so we will watch this closely to see what comes out of it.

Here is a quick summary of the bills that have been introduced thus far.

HB9 would increase penalties for gun owners if their gun was accessed by a minor and someone was injured.

HB50 would make it a felony to possess a magazine that holds more than 9 rounds.

HB72 would make it felony to possess a bump stock, binary trigger, or anything else that "increased the rate of fire of a semiautomatic firearm."

HB100 would put into place a 14 day waiting period for firearm purchases from a FFL.

HB101 would make it a felony to possess a semiautomatic rifle, some semiautomatic pistols and shotguns as well as a magazine that holds more than 9 rounds.

We are still expecting more bills to be filed. This is the most consequential session for gun owners in the history of our state. The bills that have been filed would require you to surrender your guns, magazines and accessories to the state, destroy them or face potential jail time.

We need every gun owner in the state to get involved. Working with our partners at Better Together NM, we put together this form that easily enables you to email your state representative and senator and tell them to oppose these five bills.

From The New Mexico Shooting Sports Association Newsletter

This week's newsletter from the New Mexico Shooting Sports Association summarizes the anti-Second Amendment bills in the New Mexico legislature's hopper for the legislative session starting tomorrow.

They are:

2023 Anti-Gun Bills

HB101 If you own a semi-automatic rifle you would have to destroy it or surrender it to the state by July 1 of this year or you would be committing a felony. The bill also makes it a felony to own a magazine that holds more than 9 rounds.

HB9 creates a fourth-degree felony penalty for a person who keeps or stores a firearm in a manner that negligently disregards a minor's ability to access that firearm and the minor accesses that firearm and uses it in a manner that causes great bodily harm to or death of the minor or another person. If the same circumstances existed and the minor displays or brandishes the firearm in a threatening manner or causes injury to himself or another person not resulting in great bodily harm or death, the person is guilty of a misdemeanor. A person does not violate the provisions of the act if a minor obtained the firearm as a result of an illegal entry to the person's property; if the firearm was kept in a locked container and was securely stored or kept in a location that a reasonable person would believe to be secure when obtained by the minor; if the firearm was carried on one's person or within close proximity of the person; if the firearm was locked with a firearm safety device that rendered the firearm inoperable; or if the minor obtained the firearm in the course of self-defense or defense of another person.

HB50 POSSESSION OF LARGE CAPACITY GUN MAGAZINE - That bill would make it a felony to own a magazine that holds more than 9 rounds which would apply to most firearms with a detachable magazine.

HB72 POSSESSION OF SEMIAUTOMATIC FIREARM CONVERTER

HB100 Puts a mandatory 14-Day hold on all firearms sales from an FFL.

The New Mexico Legislature convenes on January 17 and will meet for 60 calendar days.  Here is a link you can use to find the contact information for your legislator:  https://www.nmlegis.gov/Members/Find_My_Legislator

Dems Drop Two New Radical Anti-gun Bills

The Democrats in the New Mexico are hell-bent on violating the Second Amendment rights of New Mexico citizens. They are also blatantly unconstitutional.

The Piñon Post reported:

On Thursday and Friday, Democrats dropped more anti-gun bills to assault New Mexicans’ Second Amendment rights.

On Thursday, far-left legislators state Rep. Patricia Roybal Caballero (D-Bernalillo) and state Sen. Linda Lopez (D-Bernalillo) dropped H.B. 72, which makes it illegal to “knowingly possess or transfer a semiautomatic firearm converter,” making the sale of any kind of modification device to enhance usability a fourth-degree felon.

H.B. 72 requests $1.5 million from the state to enforce the extreme anti-gun bill.

Another bill, H.B. 101 by far-left state Rep. Andrea Romero (D-Santa Fe), bans large-capacity magazines “regardless of whether the device is attached to a firearm.” It forces anyone owning such magazines to “remove the large-capacity magazine from the state,” “sell the large-capacity magazine to a licensed firearms dealer,” or “surrender the large-capacity magazine to a law enforcement agency for destruction.” It includes no grandfather clause and would take effect July 1, 2023, if passed. Any violator of the proposed law would be a fourth-degree felon.

Furthermore, anyone who owns any semi-automatic firearm, which Romero dubs an “assault” weapon, would be forced to either “remove the assault weapon from the state,” “render the assault weapon permanently inoperable,” or “surrender the assault weapon to the appropriate law enforcement agency for destruction.” Like the previous section of the bill, anyone not in compliance will become a fourth-degree felon.
