CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This Contract made and entered by and between:

COMMISSION ON ELECTIONS, with Office address at Intramuros

Manila, herein represented by ATTY. DATUMAMA M. MACAINDIG, Election
Officer, COMELEC, Las Piñas City, NCR-4th District, hereinafter referred to as
the FIRST PARTY.

and

________________________________ of legal age, Filipino and with

residence at ________________________________ presently/previously
employed at ________________________________ graduate of
____________________________; herein referred to as the SECOND
PARTY.

WITNESSETH

1) That the First Party is in need of the service of the Second Party as
DESO TECHNICAL SUPPORT STAFF in connection with the 12
May 2025 National and Local Elections;

2) That the Second Party has signified his/her intention to serve as DESO
Technical Support Staff and passed the written examination conducted
by the First Party, and the former has accepted to provide the service
needed by the latter;

3) That the Second Party hereby possesses the qualifications, such as the
education, experience and skills required to perform the job as
described herein;

4) That the Second Party, shall attend and complete all the COMELEC-
sponsored trainings, briefings and meetings as scheduled and to be
conducted by the First Party, on the matter;

5) That the Second Party hereby attests that he/she is not related within
the 4th civil degree of consanguinity or affinity to any member of the
Electoral Board or to any candidate to be voted for in the polling place
of assignment or to the said candidate’s spouse;

6) That he/she has not been previously dismissed from government
services nor has any pending administrative case or criminal case field
against him/her;

7) That in view hereof, the Second Party is hereby contracted for the
period of 02 May 2025 to 12 May 2025 and shall be paid an
honorarium in the amount of Php9,000.00 subject to tax, in
consideration of services rendered, to be paid within fifteen (15) days
from the date of election or from receipt of complete requirements as
required by the Finance Services Department, subject to the existing
rules and regulations of the Commission on Audit (COA);

8) That the First Party shall assign the Second Party to polling center/
barangay within the municipality/city of ________________;
(based on the former’s judgment and discretion);

9) That the Second Party is expected to perform the following duties and
functions as DESO Technical Support Staff, viz:

a) Report during the scheduled FTS and on Election Day in the voting
center where they are assigned;

b) Remain in the assigned voting center for the entire duration of the
FTS; and on Election Day, until all the activities are concluded;

c) Report to the NTSC and EO during the conduct of the FTS and on
Election Day the following:

1) Date and time of arrival at the voting center;

2) Date and time of successful installation of the ACM of the

assigned clustered precinct/s;

3) Date and time of the start of voting of the assigned clustered

precinct/s;

4) Date and time of the close of voting of the assigned clustered

precinct/s;

5) The status of transmission of the assigned clustered precinct/s

on Election Day.

6) Missing items in the ACM case of the clustered precincts

under his/her jurisdiction, if any;

7) Defective storage device for replacement; and

8) All other information or reports that may be required of them.

d) Assist the EB in the installation of ACM, if so required.

e) Troubleshoot the ACM in case of technical issues and provide

solution. In case the technical issues cannot be resolved, refer to the
NTSC for the proper resolution.

 f) Perform such other functions which the Commission may prescribe
from time to time.

10) That the Second Party shall observe all policies and guidelines of the
Commission governing security and privacy of personal data insofar as
they relate to voter information protected under the Data Privacy Act
(RA No. 10173);

11) That the Second Party shall perform report for duty/work at a time and
schedule to be agreed upon by both parties;

12) That it is understood that this contract does not create an employer-
employee relationship between the First Party and the Second Party;

13) That the Second Party of this agreement may be terminated in any of
the following grounds:

a. Violation by the Second Party of any of the terms of the contract;

b. Upon payment and completion of the job required;
