I am intrigued by the membership of the Coconut Grove 2030 Group. Anyone want to fill in the public? I went to a Park's sub-committee meeting and I think I was pretty annoying, not intentionally. They were very nice people. I doubt they will ask me back.

MOMA has a Muslim artist featured in every gallery in response to Trump's Muslim ban. It is very disconcerting to see a Matisse room with a piece of unlike art stuck in there.

I read Vice Mayor of Palmetto Bay, John Dubois' deposition. Such a putz.  Really.

Yes, I did pass Trump Tower.  I wanted to see if the garden changed.

Erica Watts for Vice Mayor of Palmetto Bay. By Geniusofdespair

I endorse Erica Watts for Vice Mayor of Palmetto Bay in the Runoff on Tuesday.  I don't believe John Dubois cares about anyone but his own interest (For instance, I don't believe he cares about YOUR TRAFFIC). The fact that the future development can be seen from his compound is pretty significant. It is funny that the residents only care about traffic. In 2009 - 10 years ago we wrote:
And to the letter writer, "Traffic on Old Culter Road is a nightmare." you should have gone to the Greater Miami Chamber of Commerce meeting, recently, so that citizens could give suggestions on how to "improve" traffic in Miami-Dade. The cost for a seat was $125.

Now there's a GOOD one! Pay $3 for gas, sit in traffic for two hours a day, and pay $125 to complain about it.

John Dubois and his buddies are saying that Eye of Miami's Geniusofdespair is Eugene Flynn. That of course is not true. I am a woman. I have posted that previously.

And, John Dubois knows perfectly well who I am as he sued me, Gary Pastorella, the Former Mayor Shelley Stancyk, the Deputy County Manager, the head of Derm, an officer of Derm (he had to pay attorney fees on that one) and now the Ethics Department Chief, Joe Centorino. You would think he would remember the targets of his SLAPP suits (a strategic lawsuit against public participation) -- but I guess not.  Perhaps there are just too many of them. But in the end: I swear on my mother's grave: I am not Eugene Flinn.

I called John Dubois an asshole in front of him and I stand by my opinion. Please take the time to vote Tuesday and don't vote for Bagel Boy (yes I read all of his depositions and I didn't see anything about Kansas).

Palmetto Bay Runoff: Dubois vs. Erica Watts: Easy Choice. By Geniusofdespair

Dubois has been a lightning rod for controversy. The Department of Environmental Resources Management cited him for allegedly chopping down swaths of delicate, environmentally needed mangroves that blocked the view of the water from his mansion. Dubois has denied removing the mangroves. The county is suing him in an effort to force him to replace them. Dubois is counter-suing the county. He also sued the DERM inspector who cited him. A judge threw out the suit and ordered Dubois to pay some $66,000 in attorney fees. Even as he denies having destroyed the mangroves, Dubois claims he has replaced them.The county issued a statement refuting that claim. “The mangroves have not been replanted in the area from which we allege they have been removed,” the statement said. Environmental regulators declined further comment citing the suit/countersuit going on with Dubois.

MIAMI (CBSMiami) — First-term Palmetto Bay Vice Mayor John Dubois is running for re-election with a target on his back.

At its center is accused pedophile, Stanley “Junior” Kowlessar. Kowlessar allegedly broke into a neighbor’s Palmetto Bay home in the middle of the night in February, 2015, sexually molesting a nine-year-old girl in her bed.

Kowlesssar needed a place to live, after being ordered by a judge to remain at least 500 feet away from his alleged victim. In court, Vice Mayor Dubois spoke up for the alleged molester – the son of Stanley Kowlessar Sr., a Dubois friend and supporter.

Dubois told the judge in a hearing, “I don’t believe there is any possibility whatsoever that Junior did what he is accused of.”

And where did Junior Kowlessar go to live? In Vice Mayor Dubois’ multi-million dollar bayfront home. He had lived with the Vice Mayor for more than two months when CBS4 News revealed the living arrangements.

Dubois made no apology at the time, when questioned by CBS4’s Gary Nelson.

“He’s a good family friend, U.S. Marine, and I’ll do everything I can to help,” Dubois said.

The vice mayor remained loyal to his housemate by the bay, even after two more alleged victims came forward, claiming Junior Kowlessar had molested them years earlier when they were living in the same house as the girl in the case Kowlessar is charged with.

“I have every faith and confidence that the system will work this out and that these charges will be rectified and dropped,” Dubois said at the time.

The vice mayor even threw a fund-raising barbecue to help in Kowlessar’s defense, an event promoted in the village newspaper.

The 9-year-old’s father was livid with Dubois.

“I don’t recall seeing him in my daughter’s room on the night this crime was committed. I was there. I saw the defendant in my daughter’s bedroom,” the father said in a June, 2015, during an interview with CBS4.

Under a bright media light, Dubois found Kowlessar a new place to live – in the home of a supporter a few blocks away.

Since the events of last year, and waging a re-election campaign, the vice mayor is still supportive of Junior Kowlessar.

“I am not going to apologize for standing up for a friend or family member in a time of need,” Dubois told CBS4 in a recent interview.

It is an issue in the race. Business owner and activist David Zisman is one candidate challenging Dubois.

“For an elected official to take sides on any issue involving something as horrible as this is just a complete lack of judgment,” Zisman said.

Long-time PTA president Erica Watts – one of many parents who attended hearings opposing Kowlessar’s release – had considered running for office, and Dubois’ embrace of an accused molester may have been the tipping point.

“Having been a child victim of abuse myself, I know what it is to be small and not believed,” Watts said. “And then imagine that you’re a family here in the village and your own representative and his powerful friends try to discredit you and your small child.”

“I’m outraged,” said the father of the 9-year-old alleged victim, who is campaigning among his neighbors and in blind posts on the internet against Dubois’ re-election.

“He has no values. He purports to say that he’s looking out for the best interests of the children of Palmetto Bay. That’s laughable. That’s a joke,” the father said.

Dubois, the father said, was calling him and his daughter liars – taking the word of an accused molester against theirs.

Dubois responded, again without apology.

“I would just say that I always stand by my friends and family in times of need, and that’s what I did here,” Dubois said.

Dubois said enemies on the town council have recruited challengers and fueled criticism of his role in the sex abuse case. They want to see him defeated because he has been critical of what he calls a pro-development, “corrupt” process. Dubois is particularly critical of a council vote rezoning a large tract on Old Cutler Road that could allow nearly 500 living units to be constructed there, adding to what is already nightmarish traffic during rush hour.

Watts denied being recruited to challenge Dubois, calling it ridiculous.

“No one put me up to this. I’m running on my own merits, and I want to serve the people of Palmetto Bay,” said Watts, who has served on the Village’s Education Advisory Committee, and worked in public service for years providing legal aid to underprivileged clients in family court. She has a degree in economics and law and is married with a child.

Zisman laughed at the notion that he was in any way recruited to oppose Dubois. Zisman has been active in village politics for years, has run for the council three times, and served on the village’s Charter Review Committee.

Dubois has waged a “green” campaign. His flyers and commercials tout his commitment to the environment.

Zisman calls that odd, given the allegedly mangled mangroves.

“It’s hypocritical. You can’t justify what his campaign is about with what his actions have been,” Zisman said.

Dubois has a treasure chest of campaign finance money, more than $120,000 at last report, most all of it from his own pocket.

“I wonder why he’s spending over $100,000 to keep a job that pays $12,000 a year,” Watts said, noting that Palmetto Bay is a small town of just 23,000 residents.

Dubois’ reply?

“I’ve been fortunate that I’ve been successful in business and I’ve been able to put my money where my mouth is,” Dubois said.

Dubois has also sued the Miami-Dade County Commission On Ethics, saying they have “lied” as they reportedly investigate whether he improperly voted on the Old Cutler Road development proposal. Because Dubois lives almost next door to the property in question, the suggestion is he had a conflict of interest in voting on the issue. In a prior vote, Dubois had in fact recused himself.

The vice mayor has a history of not taking kindly to criticism. He sued a blogger who was critical of him on the web, according to the Miami Herald. That suit has not advanced.

While Dubois says his key concern as he seeks re-election is traffic and over development, Zisman says he intends to be a vice mayor accessible to the people.

“I have a proven track record of defending the rights of the citizens, everybody in Palmetto Bay, and that is the voice that I have for the people,” Zisman said.

Watts stressed that while Dubois has a campaign chest of more than $100,000 and Zisman has raised more than $50,000, she has only about $5,000 in her account, small donations primarily from friends, she said.

“I am indebted to no special interests,” Watts said. “I truly just want to serve the residents of Palmetto Bay, no one else.”

Stanley Kowlessar, the accused child molester, is set to stand trial November 14th, six days after his friend, Vice Mayor Dubois, stands for re-election.

Sue the Shit out of the Miami Herald John Dubois! Palmetto Bay Vice Mayor John Dubois Featured in the Miami Herald - Not in a Good Way. By Geniusofdespair

As the blogger sued (Popular Community Blog), let me just say, I believe John DuBois is a bully, I believe he is a Vexatius Litigator. I believe that he likes to think of himself as a wine connoisseur - hanging out with the elite set -  but I believe he still  acts like the bagel boy he was in New York years ago. 
Note all the "I Believes" qualifying my beliefs....that I believe, of course all the beliefs are also in my opinion.
When a popular community blog wrote posts that criticized John Dubois, the vice mayor of Palmetto Bay, he sued.

When a village resident passed out fliers unfavorable to Dubois during the 2012 elections, he sued. When the county cited him for cutting down mangroves, he sued.

And when ethics investigators opined that Dubois committed ethical violations this year? Yep. He sued.

In the four years Dubois has been in office, he has sued at least 10 people or entities in four lawsuits. Some have called his suits legal bullying or frivolous, including a judge who ordered Dubois to pay the attorney’s fees of the person he sued.

“I like to protect my rights and when people violate them, you better believe it I’m going after them,” Dubois told the Miami Herald. “So yes, if someone violates me, I’m going to react.”

Dubois, CEO of a cloud-based security surveillance company, was elected Palmetto Bay’s vice mayor in 2012. Most, but not all, of the lawsuits pertain to something he did or was criticized for in that capacity. The city did not pay for any of the lawsuits.

The vice mayor’s pattern of filing complaints is “possibly an abuse of the court,” said Donald Jones, a First Amendment law professor at the University of Miami.

“Anyone who is a public figure is subject to fair comment about them and their capacity as a public figure,” Jones said. “You misuse the court if you use it to try to censor the opinions of others. … The question here is, are these complaints valid or not? When you sue the ethics commission, the person who serves you with a notice, or a blogger, that sounds pretty odd to me. ”

In June, the Miami-Dade County Commission on Ethics and Public Trust said that Dubois committed ethical violations when he participated in a vote in May despite the advice of county ethics officials that he not vote. Dubois says he voted after he got a green light from state ethics officials and that he never asked the county for an opinion.

A month later, Dubois filed a civil rights lawsuit against the commission, accusing executive director Joseph Centorino of “furnishing false information and omitting significant facts to members of the public,” ultimately damaging his reputation. This case is still pending.

The lawsuit is no surprise to some lawyers who have represented people targeted by Dubois.

Ben Kuehne, a Miami attorney who has represented three defendants sued by Dubois, called his dealings “quite frightening.”

“For Dubois, it’s ‘Don’t mess with me or I’ll mess with you,’ ” Kuehne said. “He makes allegations, requires the citizens to obtain a lawyer and then fight the case in court. It’s expensive and stressful, and they nonetheless have to defend themselves against what in my opinion is a legal bullying tactic.”

In 2013, Dubois filed a lawsuit against Palmetto Bay resident Gary Pastorella after he said Pastorella “ginned up slander sheets” targeting him during election season. Dubois later withdrew the case.

In that same 34-page lawsuit, Dubois sued the no-longer published blog “Pbcheckstherecord.Org” for libel, calling the then-unidentified authors “cowards” for publishing “misleading photos” and “scurrilous fabrications.” Dubois said it “damaged and defamed” him.

The case was ultimately dismissed. It was later discovered that the creator of the blog was Shelley Stanczyk, the former mayor of Palmetto Bay.

Also sued were Nancy Lee, the creator of a community watchdog blog, for slander and defamation of character, among other things, after her blog posted a photo sketch of mangrove growth in front of Dubois’ home, alluding to the citation he got for cutting down mangroves. After Lee submitted legal questions to be answered by Dubois, he dropped her and her husband — also named in the suit — from the case.

UM professor Jones said it’s not uncommon to group defendants in one lawsuit, even when the defendants all acted independently of each other, because the court in most cases considers it “efficient.”

“The question is, is he bunching them together because he wants to be efficient or is it because he’s simply upset with all of them. Is there an emotional driver here?” Jones said.

Caroline Mala Corbin, a professor of constitutional law, said it’s very difficult for a public official to win a defamation suit because “first the statement has to be false and made with actual malice, meaning the person making the claim has to have known that it was false.

“So even if the statement turned out not to be true, the false statement is still protected. The reason why the free-speech clause [of the Constitution] provides so much protection is to make sure that defamation suits don’t chill criticism of our government,” Corbin said. “If every time you criticized an official, you had to worry if it was 100 percent true, then you might decide not to criticize them at all. We need to be able to talk about them in order for our democracy to work.”

In another suit, Dubois accused Palmetto Bay resident Elizabeth “Libby” Williams of stealing campaign signs. That case was ultimately dismissed.

Dubois also sued John Ricisak, an investigator for the county Division of Environmental Resources Management, after Ricisak cited Dubois for having cut down mangroves at his home. A judge dismissed the case, calling it frivolous, and ordered Dubois to pay almost $66,000 in attorney fees.

Right around the same time, Dubois filed a civil rights lawsuit in federal court against Miami-Dade County; Lee Hefty, the county’s environmental resources director; and county deputy mayor Jack Osterholt in connection with the same incident. The county filed motions to dismiss the case, which is still pending. Dubois claims that the county has engaged in “selective enforcement, First Amendment retaliation, discrimination” and that the citation was falsely issued, although he paid the fine.

Both lawsuits were filed after the county first sued Dubois, accusing him of filling wetlands and cutting down mangroves. The county’s case is still ongoing.

“In my opinion as a lawyer, he has a record of filing lawsuits that are not righteous, not valid, not based on a valid public purpose,” Kuehne said.

Dubois: “That’s like saying someone breaks into your house and robs you. Are you telling me you won’t press charges? I’m sure you would. When my rights are violated, I act. I don’t just sit there. ”

Jones said Dubois “needs to seriously think about whether this in itself could be damaging his career. He’s in the realm of risking sanctions against him for his actions.”

Bizarro Politics in Palmetto Bay. By Geniusofdespair

Not to be outdone by Hudstead, Palmetto Bay vies for first place:

Now you have to remember this issue was a quasi-Judicial item on the Agenda May 2nd.

Somehow the Vice Mayor of Palmetto Bay, who lives near the project, wrote to residents before the vote and even quotes himself in his release, never saw that before.

Regarding the project in question, I toured the swapped property on Old Cuttler Road and saw Dade County Pines for the first time. I did think they didn't exist anymore. I was pleased with the swap because of the quality of the developer owned lands being swapped. I do not know about zoning changes made by the council in 2008 or the circumstances of how the developer got the property. I am just commenting on the property I toured. However, I would rather see the development back further from the road anyway.

The item passed except for Vice Mayor John Dubois, who did a reversal on recusing himself (He lives very close to this property) and Councilwoman Karen Cunningham, Dubois' best bud on the Council. She is also eyeing the Mayor seat of Mayor Eugene Flinn. Speaking of friends, Dubois temporarily housed an accused sex offender of young girls in his home for his friend.

Here is the Dubois email to residents, sent out looking like a press release, before the quasi-Judicial vote:

PALMETTO BAY MAYOR CONTINUES TO SUPPORT A MASSIVE DEVELOPMENT PROJECT THAT COULD TURN OLD CUTLER ROAD INTO A PARKING LOT
(Palmetto Bay, FL) - The Village of Palmetto Bay, long renowned as a quiet, picturesque, and environmentally responsible bedroom community is on the brink of becoming just another over-developed, traffic congested municipality in Miami-Dade County - if the Village's Mayor, Eugene Flinn, and his developer friend get their way.

While serving as Mayor during his inaugural term in February of 2005, Eugene Flinn and his developer friend began increasing the residential development density of the old Burger King Corporate property, now known as the "Palmetto Bay Village Center" on Old Cutler Road, despite strong development opposition by the community for decades. On June 9th, 2008, Flinn voted to "Up-Zone" the property from exclusive use for office space to allow an additional 100 townhomes and 300 bedrooms/units for elderly housing. At the time, the developer stated - "this [elderly housing] type of facility would lessen traffic flow."
Palmetto Bay Vice Mayor John DuBois, who lives a few properties to the North, believes that if the proposed ordinances recently presented to the Village Council and supported by Mayor Flinn are approved, there will be a major traffic crisis in Palmetto Bay. The traffic generated by 100 homes Flinn initially approved in 2008 along with traffic from the additional 385 homes he is trying to approve now could increase car traffic by a factor of 5 on a road that already resembles a parking lot during morning and evening rush hours. This act would destroy the quality of life for residents of Palmetto Bay and Cutler Bay.

To justify this 5-fold increase in residential traffic flow, Mayor Flinn and his developer friend are now claiming that "it is a good deal for the Village because Palmetto Bay is getting 40 acres of new park land." This is an expertly crafted deception that has even pulled the wool over the eyes of the environmental community. The reality is that these 40 acres include environmentally sensitive lands that cannot be developed for residential purposes. These 40 acres are divided into 2 sections - first is a 22-acre section which already has a land use designation of "Parks and Recreation" the second are 18-acres of mangroves and wetlands that are environmentally protected by government regulation.
"The Mayor's actions could result in a traffic disaster to already gridlocked roads used by residents of Palmetto Bay and Cutler Bay that would only benefit Flinn's developer friend." - Said Vice Mayor John Dubois. - Added Dubois

If I had it my way, I would draft Erica Watts, an incredible woman (sitting next to Al Sunshine) to be the next Vice Mayor of Palmetto Bay. Erica You Must Run!

BTW wetlands are not really as protected by Government regulation as Dubois said. If they were, we wouldn't have half the development in Florida that we have. The Developer is able to do mitigation somewhere else (there are very lucrative mitigation banks) for destroying wetlands and bingo, he or she has their development.

Mayor Flinn said of his vote:
I received no donations from Scott Silver the owner of the Palmetto Bay Village Center. He is an acquaintance, not a friend.

My vote was based upon the law as presented by our village attorney, the facts, the traffic study which showed no impact from the existing plan, as well as the fact that I was able to preserve 40 acres of land. I am looking forward to preserving and beginning a similar effort to what is going on on the Cutler Bay side with their restoration along Old Cutler Road.

Vice Mayor of Palmetto Bay John Dubois: Oh the Web we Weave in Miami Dade County. By Geniusodespair



John Dubois is back using lawsuits to solve his apparent distaste for the way Derm pursues mangrove protection. He is now suing in Federal Court instead of Civil Court. This time he is suing Jack Osterholt (deputy Mayor) and Lee Hefty (head of DERM). Above is the lawsuit. In Federal Court he refers to the the Constitution -- discrimination. Read it for yourself. Civil Rights? John Dubois? Interesting.  Apparently he might have a lawyer a few years out of law school on retainer, who might be using a UPS Store address in this document, mail box 107, 1845 South Dixie Highway, Cutler Bay.

 You will remember a few months ago, Dubois had raised eyebrows in Palmetto Bay for holding a fundraiser for an accused sex offdender he had as his houseguest (he is not a house guest anymore):
Dubois not only has given Junior Kowlessar shelter. The Palmetto Bay News reports he held a fundraiser at his home on the bay to raise money for Junior Kowlessar’s defense.

John Dubois, Palmetto Bay Vice Mayor, has an Accused Pedophile living at his house for the last two months. By Geniusofdespair

Not having seen the TV new last week, I didn't know accused Pedophile Stanley Kowlessar -- Marine Corps Vet -- was living for the last two months at Vice Mayor John Dubois's house in Palmetto Bay. Bravo to Gary Nelson for his exclusive report. Kowlessar is accused of sexually assaulting three former neighbors, one 9 years old.

Daddy Kowlessar supported both Lynda Bell and John Dubois in their campaigns.

According to the video, the dad Kowlessar Sr. knew about the first two and talked the neighbor out of reporting the crimes. He said he would get his son counceling. He is a plant Manager for Atlas Aerospace. Stanley Kowlessar Sr. has a Corporation with David Zisman. The first neighbors now say they are sorry they did not report the two assaults (rape included) because it might have prevented the third alleged assault to the 9 year old. The kid blames it on PTSD. I don't think so, rape and pedophilia are not a symptom.

Dubois held a fundraiser for the younger Kowlessar. Maybe Governor Rick Scott will kick in some money. The parents of the little girl next door to the Kowlessar family were outraged at Dubois's activities.

It this appointment keeps Lynda Bell out of our hair, I congratulate Lynda Bell. I know many of you may disagree on the congratulations but it looks like Geline, the former Chairman of the Board of National Right to Life, needs a rest and Lynda certainly needs something to do. Geline was also the Mayor of Richmond Virginia for 2 years.  I would think that Lynda will have to travel a lot now. She will get to meet my candidate Ted Cruz. It will be fun for her. I wish her well...if she stays out of Florida and doesn't change Roe vs. Wade.

Maybe that is why John Dubois, Palmetto Bay Vice Mayor,  took Lynda and Mark Bell out to dinner earlier in the week? Maybe they were celebrating The National Right to Life Chairmanship post? Dubois does like celebrating with her. When she won the election to the County Commission, years and years ago (4 but it seems like more)...he had the victory party at his home.

The Only Candidates Registered in Miami Dade County for the 2016 Election....and SOME GOSSIP. By Geniusofdespair

 We all know elections are coming up....

I guess we need all that election crap on the outside to fingerprint children.....??? I don't want Justice in motion. I want some arrests. This was seen on Riverday, on the Miami River. I went inside, no one was there but I did get the third degree.
The Mark Bell Absentee Ballot Fraud Case Update from Rundle's office: The two men went to trial April 6th and will appear again on June 8th. They are currently taking deposition from Jorge Luis Castillo's 2 fall guys in the case. The judge is Victoria Brennnan.  How about we get the real culprit who sent them out there to this Homestead family to steal their absentee ballots.


The Gossip....

Palmetto Bay Vice Mayor John E. Dubois was seen at dinner in South Dade with none other than Former County Commissioner Lynda Bell and her husband, Mark Bell. Was he asking about the Redinn mortgage on the Redland Hotel? John DuBois, is Mgr. of the Redinn Coporation. Whatever happened to the case having to do with absentee ballots for Mark Bell's mayoral run?

A former city manager in Homestead, before his promotion,  said that the Mayor at the time told him I am your boss you take orders from me. Of course, we all know Hudstead is not a strong Mayor place and the staffer only should take order from the manager.

All those county attorneys we pay (what do we have, a couple of hundred?)  and this case has been going on for almost 3 years against John E. Dubois (is this still the illegally cutting Mangrove Case??), Vice Mayor of Palmetto Bay...

The top Attorney for Miami Dade County, Robert Cuevas, Jr. is retiring. Since they always get people in house, instead of doing a professional search, expect Abigail Price-Williams to take over.

Vice Mayor of Palmetto Bay John Dubois intends to Appeal The Judges Decision in his Mangrove Cutting Case. By Geniusofdespair

According to the Miami Herald,
DuBois has filed formal notice of his intent to appeal. He did not respond to requests for interviews left via e-mail, text message and voicemail, but has previously maintained his innocence – publicly and throughout court proceedings – alleging that the environmental agency’s actions are part of a calculated political campaign to discredit him. 
AND:
“Typically people don’t fight us in a situation like this,” said Assistant County Attorney Tom Robertson, adding that DuBois had already filed a notice of appeal for the March 18 decision. “There’s no question that the violation exists. Most people say, ‘oh, let me correct it.’ Whether it was accidental or intentional, usually when you catch people, they fix things.”
