"Treaty" was written by Australian musician Paul Kelly and Yothu Yindi members Mandawuy Yunupingu, Kellaway, Williams, Gurrumul Yunupingu, Mununggurr and Marika and Peter Garrett. The initial in June 1991 release received limited radio and television exposure (mainly on ABC radio and SBS television). "Treaty" peaked at No. 11 on the ARIA Singles Chart in September 1991. In May 2001 "Treaty" was selected by the Australasian Performing Right Association (APRA) as one of the Top 30 Australian songs of all time. In 2009 "Treaty" was added to the National Film and Sound Archive's Sounds of Australia registry. In January 2018, as part of Triple M's "Ozzest 100", the "most Australian songs of all time", the Filthy Lucre version of "Treaty" was ranked number 10. Their original remix back in 1991 won an Aria Award for best single of the year in 1992 and became a dance sensation in Australia and around the world.“The 1991 Filthy Lucre remix of ‘Treaty’ peaked at #6 on the U.S. Billboard dance chart in April of 1992.

Yothu Yindi is the most successful and internationally recognized of Australia's aboriginal bands. Their importance lies in their fusion of traditional music and performance with contemporary rock.
The name of the band translates as "mother and child" and is essentially a kinship term used by the Yolngu people of the Northern Territory's Arnham Land. The group's central figure Mandawuy Yunupingu and clansman Witiyana Marika were originally part of the rock band the Swamp Jockeys with non-aboriginals Cal Williams and Stuart Kellaway. They gathered other aboriginal musicians and dancers to become Yothu Yindi, a troupe initially created to perform at cultural events both in Australia and internationally.

Yothu Yindi (Yolngu for "child and mother", pronounced /jɒθuː ˈjɪndi/) were an Australian musical group with Aboriginal and balanda (non-Aboriginal) members, formed in 1986 as a merger of two bands formed in 1985 – a White rock group called the Swamp Jockeys and an unnamed Aboriginal folk group. The Aboriginal members came from Yolngu homelands near Yirrkala on the Gove Peninsula in Northern Territory's Arnhem Land. Founding members included Stuart Kellaway on bass guitar, Cal Williams on lead guitar, Andrew Belletty (Drums), Witiyana Marika on manikay (traditional vocals), bilma (ironwood clapsticks) and dance, Milkayngu Mununggurr on yidaki (didgeridoo), Geoffrey Gurrumul Yunupingu on keyboards, guitar and percussion, and leader Mandawuy Yunupingu on vocals and guitar. Written by Mandawuy Yunupingu. Produced by Mark McGuire. String arrangement by Stuart Wood. Australian band, made up mostly of Indiginous persons from Australia’s Northern Territory and led by the writer here, Mandawuy Yunupingu. The group’s success on the music charts began when a re-mix of the single “Treaty” (written by Paul Kelly, Mandawuy Yunupingu and other members of the group) reached # 11. The album, “Tribal Voice” produced by Mark Moffat for Mushroom Records reached #4 on the Australian album chart. "Djäpana (Sunset Dreaming)" from the album peaked at #13 in 1992 and was featured in the Yahoo Serious film, “Reckless Kelly” in 1993.
